Se’if 1א׳
הכותב נתתי שדה פלוני לפלוני והאומר נתתי שדה פלוני לפלוני והוא אומר לא נתת לי. ובו יא סעיפים: הכותב בשטר נתתי שדה פלונית לפלוני או שכתב נתתיה לו או הרי היא שלו ה"ז זוכה בה כשיגיע השטר לידו (אבל בדיבורא בעלמא לא קנה אא"כ קנו מידו (טור בשם הרמ"ה) והא דאמרי' דלא קנה היינו שרוצה ליתן עכשיו בלשונות אלו אבל אם אמר נתתי בלשון הודאה י"א דקנה (ר"ן פ' המקבל) וע"ל סי' ס' ס"ו) אבל אם כתב בשטר אתננו לו אע"פ שהעידו עליו העדים לא זכה המקבל: הגה ואפי' קנו מידו דהוי קנין דברים (טור בשם הרמ"ה):
One who writes: I have given such-and-such a field to so-and-so; and one who says: I have given such-and-such a field to so-and-so, and he says: you did not give it to me; it contains eleven se'ifim. One who writes in a document: I have given such-and-such a field to so-and-so, or wrote: I have given it to him, or: it is his — he acquires it when the document reaches his hand (but by mere speech he has not acquired unless they made a kinyan (a formal act of acquisition) from him) (Tur in the name of the Ramah) (and this that we say he has not acquired is where he wishes to give now in these expressions; but if he said 'I have given' in the language of admission, some say that he has acquired) (the Ran, chapter "One who receives") (and see above, siman 60, se'if 6). But if he wrote in the document: I will give it to him, even though the witnesses testified about it against him, the recipient has not acquired. Hagah [Rema]: And even if they made a kinyan from him, for it is a kinyan of words (Tur in the name of the Ramah).
Se’if 2ב׳
ויש אומרים שאם קנו מידו מהני לשון אתן ומהרי"ו פסק כסברא ראשונה ולכן כתב דהכותב לאשתו בשעת השידוכין לעשות לה כתובה גדולה לא זכתה כל זמן שלא כתב לה ולכן נהגו לעשות תנאים חדשים בשעת החפה וע' באבן העזר סי' נ"א :
And some say that if they made a kinyan from him, the expression 'I will give' avails. And Maharyu ruled according to the first opinion, and therefore he wrote that one who writes to his wife at the time of the match to make her a large ketubah — she has not acquired so long as he has not written it for her; and therefore they became accustomed to make new conditions at the time of the wedding canopy. Se’if 3ג׳
ויש מי שאומר שאם כתב לו בשטר שדה פלונית תהא נתונה לך או תהא שלך קנה:
And there is one who says that if he wrote to him in a document: such-and-such a field shall be given to you, or: shall be yours, he has acquired.
