דין המזכה לחבירו על ידי אחר ורוצה הנותן או המקבל לחזור בו. ובו כה סעיפים: המזכה לחבירו מתנה ע"י אחר כיון שהחזיק הזוכה בנכסים או בקרקע או שהגיע השטר לידו זכה המקבל ואין הנותן יכול לחזור בו ויד המקבל על העליונה אם רוצה מקבל ואם אינו רוצה אינו מקבל: הגה ראובן שנדר מתנה לשלוחו של שמעון יכול שמעון להוציאה מראובן דשלוחו כמותו (הגהות מרדכי דקידושין):

The law of one who confers a gift on his fellow through another, and the giver or the recipient wishes to retract; it contains twenty-five se'ifim. One who confers a gift on his fellow through another — once the one acquiring on his behalf has taken possession of the property or of the land, or the document has reached his hand, the recipient has acquired, and the giver cannot retract; and the recipient has the upper hand: if he wishes he receives, and if he does not wish he does not receive. Hagah [Rema]: Reuven who vowed a gift to Shimon's agent — Shimon can extract it from Reuven, for his agent is as himself (Hagahot Mordechai on Kiddushin).

בד"א כשאמר לו זכה במתנה זו לפלוני אבל אם אמר לו הולך לפלוני מנה זה יכול לחזור בו כל זמן שלא הגיע ליד המקבל ואם המקבל עני אינו יכול לחזור בו (ואפילו בעשיר יש בו משום מחוסר אמנה) אם היא מתנה מועטת כמו שנתבאר: הגה (בעני) ביו"ד סי' רנ"ח סעיף י"ב) (ובעשיר) לעיל סי' ר"ד ס"ח ולקמן סי' רמ"ט אשת שמעון שנתנ' מתנה בשעת חליה ונתרצה בעלה ואח"כ רוצה לחזור אם הוא מתנה לעני לא יוכל לחזור בו (מרדכי סוף פרק הזהב):

In what case are these words said? When he said to him: acquire this gift for so-and-so. But if he said to him: take this maneh to so-and-so, he can retract so long as it has not reached the recipient's hand. And if the recipient is poor, he cannot retract (and even with a rich man it carries the fault of those wanting in faithfulness), if it is a small gift, as was explained. Hagah [Rema]: (for a poor man) in Yoreh De'ah, siman 258, se'if 12; (and for a rich man) above, siman 204, se'if 8, and below, siman 249. Shimon's wife who gave a gift at the time of her illness, and her husband consented, and afterwards she wishes to retract — if it is a gift to a poor man, she cannot retract (Mordechai, end of chapter "The gold").
