Se’if 1א׳
דין מתנה באונס ומסירת מודעה ומתנה טמירתא. ובו י סעיפים: הנותן מתנה מחמת אונס שאנסוהו ליתן אינה מתנה ואפי' קבל עליו אחריות נכסים בשטר ואפי' אם אינו מוסר מודעא אי ידעינן באונס אינה מתנה לפיכך המוסר מודעא על המתנה כתבינן ליה אע"ג דלא ידעי' באונסיה שהרי אפילו היתה המודעא שקר כיון שגילה בדעתו שאינו חפץ במתנה הרי היא בטלה:
The law of a gift under duress, and the delivery of a declaration of protest (made before witnesses, that what he does he does under duress), and a hidden gift; it contains ten se'ifim. One who gives a gift under duress, in that they compelled him to give — it is no gift, even if he accepted liability on his property in the document; and even if he does not deliver a declaration of protest, if we know of the duress it is no gift. Therefore one who delivers a declaration of protest about the gift — we write it for him even though we do not know of his duress; for even if the declaration of protest was false, since he revealed his mind that he does not want the gift, it is void.
Se’if 2ב׳
והיכא דידעינן באונסיה ומסר מודעא ובטלה לא מהני הביטול כיון דאונס הוא אפילו אי לא מסר מודעא לא הוי מתנה אבל אי מסר מודעא ולא ידעינן באונסיה ואח"כ ביטלה מדעתו הוי ביטול כיון שלא הכירו באונסו ולכך נהגו לכתוב ביטול מודעא במתנה:
And where we know of his duress, and he delivered a declaration of protest and cancelled it, the cancellation does not avail, since it is duress: even if he had not delivered a declaration of protest it would not be a gift. But if he delivered a declaration of protest and we do not know of his duress, and afterwards he cancelled it of his own will, it is a cancellation, since they did not recognise his duress. And therefore they became accustomed to write a cancellation of declarations of protest in a gift.
Se’if 3ג׳
כל מתנה בין של בריא בין של שכיב מרע צריך שתהא גלויה ומפורסמת לא מבעיא אם אמר לעדים תתחבאו וכתבו אלא אפי' אמר סתם כתבו לו אינה כלום אא"כ אמר כתבוה בשוקא וחתמו בפרהסיא וכיוצא בזה לפיכך כל שטר מתנה שאין כתוב בו ואמר לנו הנותן שבו בשווקים וברחובות וכתבו לו מתנה גלוייה ומפורסמת וכיוצא בענין זה חוששין לה שמא מתנה מסותרת היא ולא זכה המקבל ואפי' אי קנו מיניה: הגה ואפי' תפס המקבל והחזיק במתנה מוציאין מידו (טור בשם הרא"ש) מיהו אם החזיקו אותו במתנה מעכשיו לא שייך בה סתר ולכן אם כתב ליה בשטר מתנה לך וחזק ביה מעכשיו ה"ל כאלו כתב כתבוה בשוקא וכו' (ר' ירוחם נט"ו ח"ב) (וע"ל סי' זה ס"ז):
Every gift, whether of a healthy person or of a person dangerously ill, must be open and public. It is not only if he said to the witnesses: hide yourselves and write; but even if he said without specification: write for him — it is nothing, unless he said: write it in the market and sign it in public, and the like. Therefore any document of gift in which it is not written: and the giver said to us, sit in the markets and in the streets and write him an open and public gift, or something of this kind — we are concerned about it lest it is a concealed gift, and the recipient has not acquired, even if they made a kinyan from him. Hagah [Rema]: And even if the recipient seized and took possession of the gift, they take it out of his hand (Tur in the name of the Rosh). However, if they put him in possession of the gift from now, concealment does not apply to it; and therefore if he wrote to him in the document of gift: yours, and take possession of it from now, it is as though he wrote 'write it in the market', etc. (Rabbeinu Yerucham, netiv 15, part 2) (and see below in this siman, se'if 7).
