המתנה במה תתקיים וכן המחילה והנותן דבר שאינו מסויים. ובו יב סעיפים: הנותן מתנה לחבירו בין קרקע בין מטלטלין אין המקבל זוכה בה אלא בא' מהדרכים שהקונה זוכה בהם וכיון שקנה באחד מהדרכים ההם אפילו שלא בפני עדים קנה אם שניהם מודים אבל בדברים לא זכה המקבל אלא כל א' יכול לחזור בו ואם אמר ליתן לחבירו מתנה מועטת אם חוזר בו יש בו משום מחוסר אמנה: הגה וע"ל סי' רמ"ט ולעיל סי' ר"ד סעיף ה' ראובן שאמר לשמעון בית לוי נתון לך אע"פ שלוי מקבל קנין לקיים דבריו של ראובן אינו כלום (ריב"ש סי' ר"ז):

By what a gift is made to stand, and likewise a waiver, and one who gives a thing that is not defined; it contains twelve se'ifim. One who gives a gift to his fellow, whether land or movables — the recipient acquires it only by one of the ways by which a buyer acquires; and once he has acquired by one of those ways, even not in the presence of witnesses, he has acquired, if both of them admit it. But by words the recipient has not acquired, and each of them can retract. And if he said he would give his fellow a small gift, if he retracts it carries the fault of those wanting in faithfulness. Reuven who said to Shimon: Levi's house is given to you — even though Levi accepts a kinyan (a formal act of acquisition) to uphold Reuven's words, it is nothing (Rivash, siman 207).

מחל לחבירו חוב שיש לו עליו או נתן לו הפקדון שהיה מופקד אצלו הרי זה מתנה הנקנית בדברים בלבד: הגה וי"א אפילו היה לו שטר או משכון עליו אפי' הכי הוי מחילתו מחילה בדברים בעלמא (מרדכי פ"ק דסנהדרין) כל מקום דמחילה אינה צריכה קנין אי הקנה לו לפני עדים פסולים אפ"ה מחילתו מחילה (מהרי"ק שורש י"א) ועיין לעיל ריש סי' קצ"ה ולשון מחילה אינו שייך אלא במעות שחייב לו אבל אם היה לו חפץ ביד חבירו ואמר ליה מחול לך אינו כלום (תשובת הרא"ש ומהרי"ק שורש צ"ד) ועיין לקמן סימן ר"ט ס"ד מדין מחילה אדם שביקש מחבירו שימחול לו שבועה שיש לו עליו ואמר יהי כדבריך הוי מחילה אע"פ שלא אמר בפי' (מרדכי פ"ק דסנהדרין) וע"ל סימן י"ב כל מחילה בטעות יכול לחזור בו אפי' קנו מיניה (שם במרדכי ומהרי"ק שורש קי"א):

If he waived for his fellow a debt that he had against him, or gave him the deposit that was deposited with him, this is a gift that is acquired by words alone. Hagah [Rema]: And some say that even if he had a document or a pledge against him, even so his waiver is a waiver by mere words (Mordechai, the first chapter of Sanhedrin). Wherever a waiver does not require a kinyan, if he made the kinyan with him before invalid witnesses, even so his waiver is a waiver (Maharik, shoresh 11). And see above, the beginning of siman 195. And the term waiver applies only to money that he owes him; but if he had an article in his fellow's hand and said to him: it is waived for you, it is nothing (a responsum of the Rosh, and Maharik, shoresh 94). And see below, siman 209, se'if 4, on the law of waiver. A man who asked his fellow to waive for him an oath that he had against him, and he said: let it be as you say — it is a waiver, even though he did not say so explicitly (Mordechai, the first chapter of Sanhedrin). And see above, siman 12. Any waiver in error — he can retract it, even if they made a kinyan from him (there in Mordechai, and Maharik, shoresh 111).

המוחל לחבירו מה שיטול מנכסיו יכול לחזור בו קודם שיטול אבל לאחר שנטל מה שנטל נטל ודוקא מטלטלים אבל קרקע לא אפי' דר והחזיק בה וכן האומר לחבירו מנה שיש לי בידך תנהו לזה קנה ואין א' מהם יכול לחזור בו כמו שנתבאר סימן קכ"ו:

One who waives for his fellow whatever he will take of his property can retract before he takes; but after he has taken, what he took he took. And that is specifically movables, but land not, even if he dwelt in it and took possession of it. And likewise one who says to his fellow: a maneh that I have in your hand, give it to this one — he has acquired, and none of them can retract, as was explained in siman 126.
