שני שטרי מכר היוצאים על שדה אחת מזמן אחד. ובו ד סעיפים: שני שטרות היוצאים על שדה אחת בשם קונה אחד ואין זמנם שוה אם היה הראשון מתנה והשני מכר לא ביטל האחרון את הראשון שי"ל שלהוסיף לו אחריו' חזר וכתב בשם מכר אע"פ שלא היה כתוב שם אחריות שאחריות טעות סופר הוא וכן אם הראשון מכר והשני מתנה קנה השדה מזמן הראשון שלא כתב לו שטר מתנה אלא ליפות כחו משום דין בן המצר: הגה או לשאר דברים שמתנה עדיפא ממכר וצריך שלא יראה בבית דין רק האחרון דאם מראה שניהן הראשון עיקר (טור) וי"א דאם האחרון במכר אע"פ שמראה שניהם בב"ד שניהן קיימין (טור שם בשם הרמ"ה):
Two documents of sale that come out on one field from one date; it contains four se'ifim. Two documents that come out on one field in the name of one buyer, and their dates are not the same: if the first was a gift and the second a sale, the later did not cancel the earlier, for one can say that he went back and wrote it in the name of a sale to add liability for him — even though liability was not written there, since the omission of liability is a scribe's error. And likewise if the first was a sale and the second a gift, he acquired the field from the first date, for he wrote him the document of gift only to strengthen his position, on account of the law of the adjoining owner. Hagah [Rema]: Or for other matters in which a gift is superior to a sale. And he must show in court only the last; for if he shows both of them, the first is the principal one (Tur). And some say that if the last is by sale, even though he shows both of them in court, both of them stand (Tur there, in the name of the Ramah).

היו ב' השטרות במכר או שניהם במתנה אם הוסיף בשני כלום הרי הראשון קיים שלא כתב הב' אלא מפני התוס' ואם לא הוסיף בטל שטר השני את הראשון ואין לו אחריות אלא מזמן שני לפיכך כל הפירות שאכל הלוקח מזמן ראשון עד זמן שני מחזיר אותם ואם היה על אותה שדה חוק למלך בכל שנה הנותן או המוכר נותן אותו החוק עד זמן השטר השני: הגה וכ"ש אם כ' לו תחילה שדה שלם ואח"כ חצי שדה (ר"ן פ' נערה) שכיב מרע שאמר תנו מנה לפלוני וחזר ואמר כן אין לו אלא מנה אחת הואיל ולא אמר עוד תנו (מרדכי פרק נערה והגמ"ר דב"ב):
If both documents were by sale, or both of them by gift: if he added anything in the second, the first stands, for he wrote the second only on account of the addition; and if he did not add, the second document cancelled the first, and he has liability only from the second date. Therefore all the produce that the buyer ate from the first date until the second date he returns. And if there was a levy due to the king on that field each year, the giver or the seller pays that levy until the date of the second document. Hagah [Rema]: And all the more so if he first wrote him a whole field and afterwards half a field (the Ran, chapter "A young girl"). A person dangerously ill who said: give a maneh to so-and-so, and went back and said so again — he has only one maneh, since he did not say: give further (Mordechai, chapter "A young girl", and Hagahot Mordechai on Bava Batra).

שני שטרות שזמנם ביום א' והם כתובים על שדה אחד בין במכר בין במתנה אם (אין) דרך אנשי המקו' לכתוב שעות הרי הדבר מסור לדייני' כל שדעתם נוטה להעמיד שדה זו בידו יעמידו: הגה וי"א שאין דנין דין שודא דדייני רק בדיין מומחה ובקרקע (טור בשם ר"ח) וי"א דאף במטלטלים כל שאין א' מוחזק בהן (שם בשם ר"י כ"כ התו' שם ובמרדכי):
Two documents whose date is on one day, and they are written on one field, whether by sale or by gift: if it is (not) the way of the people of the place to write the hours, the matter is handed over to the judges — whoever it is that their mind inclines to establish this field in his hand, they establish it. Hagah [Rema]: And some say that they judge by the law of the judges' discretion only with an expert judge, and in land (Tur in the name of Rabbeinu Chananel). And some say even in movables, wherever neither of them is in possession of them (there, in the name of the Ri; so wrote the Tosafot there, and in Mordechai).
