Se’if 1א׳

מי שבא ואמר אבד שטר קנייתי כיצד כותבין לו שטר אחר. ובו ב סעיפים: מי שבא ואמר אבד שטר שהיה לי על שדה פלוני שקניתיה מפלוני שומעין לו לכתוב אחר: הגה וה"ה בתחלה כשקנ' יכולין לכתוב לו ב' וג' שטרות בכה"ג (ב"י בשם הרשב"א) וכותבין בו שטר זה אין גובין בו לא מנכסים משועבדי' ולא מנכסי' בני חורין ולא כתבנוהו אלא להעמיד בו שדה פלוני כדי שלא יוציאנה מידו המוכר ולא יורשיו ויש מי שאומר דדוקא מזמן ראשון ולא מזמן שני דאיכא למיחש שמא אח"כ חזר ומכרה למוכר ומוציא אח"כ זה (שטר) השני שזמנו אחר המכיר' שמכר ויאמר הדרית וזבינית ממך:

One who came and said: my document of purchase is lost — how they write him another document; it contains two se'ifim. One who came and said: a document that I had on such-and-such a field, which I bought from so-and-so, is lost — they listen to him to write another. And there is one who says that it is written specifically from the first date and not from the second date, for there is to be concerned that perhaps he afterwards went back and sold it to the seller, and afterwards he will produce this second (document), whose date is after the sale that he made, and will say: I went back and bought it from you.

אף על גב דשטרי חוב המאוחרים כשרים שטרי מכר המאוחרין פסולין אם לא פירש בהם שהם מאוחרים:

Even though postdated documents of debt are valid, postdated documents of sale are invalid, unless it is specified in them that they are postdated.
