כותבין שטר למוכר ולא ללוקח. ובו ג סעיפים: כותבין שטר למוכר שמכר שדהו לפלוני אע"פ שאין אותו פלוני לפנינו והוא שמיד הקנה לו השדה בקנין או שהעיד על עצמו שכבר קנה באחד מדרכי הקנייה ובלבד שיהיו העדים מכירים השמות שבשטר שזהו פב"פ וזהו פב"פ אבל אין כותבין שטר ללוקח אלא מדעת המוכר ויש מי שאומר שאפי' קנו מהמוכר שהקנה לפלוני שלא בפני הלוקח ובא הלוקח שיכתבו לו השטר אין שומעין לו שלא אמרו סתם קנין לכתיבה עומד אלא בפניו: הגה מי שבא לעדים ואמר בית שיש לי במקום פלוני אני נותנו לפלוני אע"פ שאין העדים יודעין אם יש לו בית במקום פלוני או לא יכולין לכתוב דהרי אינן מעידין רק על המתנה ואם אין לו ממילא המתנה בטילה (מרדכי סוף פרק המוכר פירות):

They write a document for the seller and not for the buyer; it contains three se'ifim. They write a document for the seller, that he sold his field to so-and-so, even though that so-and-so is not before us, provided that he conveyed the field to him at once by a kinyan (a formal act of acquisition), or that he testified about himself that he had already conveyed it by one of the ways of acquisition; and provided that the witnesses recognise the names in the document — that this is so-and-so son of so-and-so, and this is so-and-so son of so-and-so. But they do not write a document for the buyer except with the seller's knowledge. And there is one who says that even if they made a kinyan from the seller that he conveys to so-and-so, not in the presence of the buyer, and the buyer came so that they should write him the document, they do not listen to him; for they said that an unspecified kinyan stands for writing only when it was made in his presence. Hagah [Rema]: One who came to witnesses and said: a house that I have in such-and-such a place I give to so-and-so — even though the witnesses do not know whether he has a house in such-and-such a place or not, they may write, for they testify only about the gift; and if he has none, the gift is void of itself (Mordechai, end of chapter "One who sells produce").

Se’if 2ב׳

הלוקח נותן שכר הסופר אפי' במוכר שדהו מפני רעתה:

The buyer pays the scribe's fee, even where one sells his field because of its poor quality.

Se’if 3ג׳

יש מי שאומר דהא דכותבין שטר למוכר אע"פ שאין לוקח עמו דוקא כשמעידים על עצמו שכבר קיבל המעות מיד הלוקח ואם לא כתבו כן כשיתבענו לדין ליתן הדמים צריך להביא ראי' שמכיר' זו היתה מדעתו ויש מי שאומר שאפי' העידו על עצמו שקיבל המעות אם משמע מתוך השטר שהמקח הוא מדעת שניהם אין כותבים ויש מי שאומר שכותבין אפי' לא העידו על עצמו שקיבל המעות: הגה שהרי שטר זה אינו מכריח הלוקח שיקנה דאינו אלא לראיה (טור שם בשם הרמב"ן) ולכן הלוקח נאמן ג"כ לומר שנתן המעות (ב"י בשם תשובת הרשב"א אלף קל"ו) שטר מכר שלא כתוב בו סכום המקח רק ענין המקח השטר כשר (תשו' רשב"א אלף תתקפ"א):

There is one who says that this rule — that they write a document for the seller even though the buyer is not with him — is specifically where they testify about him that he has already received the money from the buyer's hand; and if they did not write so, when he summons him to judgment to pay the price, he must bring proof that this sale was with his knowledge. And there is one who says that even if they testified about him that he received the money, if it is implied from within the document that the sale is with the knowledge of both of them, they do not write it. And there is one who says that they write it even if they did not testify about him that he received the money. Hagah [Rema]: For this document does not compel the buyer to buy, since it is only for proof (Tur there, in the name of the Ramban); and therefore the buyer too is believed to say that he gave the money (Beit Yosef in the name of a responsum of the Rashba, siman 1136). A document of sale in which the sum of the price is not written, but only the matter of the sale — the document is valid (a responsum of the Rashba, siman 1981).
