המחזיר אחר דבר לקנותו וקדם אחר וקנאו. ובו ב סעיפים: המחזיר אחר דבר לקנותו או לשכרו בין קרקע בין מטלטלים ובא אחר וקנאו נקרא רשע והוא הדין לרוצה להשכיר עצמו אצל אחר וי"א שאם בא לזכות בהפקר או לקבל מתנה מאחר ובא אחר וקדמו אינו נקרא רשע כיון שאינו דבר המצוי לו במקום אחר (והקונה קרקע על מצר חבירו אע"פ שאין בה משום דינא דבר מצרא יכול בעל מצר (לקדמו) לקנותה ולא מקרי רשע דהוי כמציאה (ב"י בשם מרדכי פ"ק דמציעא) וכן אם קונה דבר אחד ובא חבירו ויוכל לקנותו בזול שאינו מוצא לקנותו כך במקום אחר הוי כמו מציאה ויוכל לקנותו כל זמן שלא זכה בו הקונה) (תשו' מהרד"ך בית ל"א) וי"א דלא שנא: הגה וסברא הראשונה נראה עיקר ואפי' לסברא זו דוקא בעני אבל בעשיר לא אם לא (בדבר) שאינו מצוי דאז אפי' בעשיר מקרי רשע (ר"ן שם בשם הרמב"ן פ' האומר בקידושין) וע"ל סי' קנ"ו סעיף ה' וכל זה לא מיירי אלא כשכבר פסקו הדמים שביניהם ואין מחוסרין אלא הקנין אבל אם מחוסרין עדיין הפסיקה שהמוכר רוצה בכך והקונה רוצה יותר בזול מותר לאחר לקנותו בין אם המוכר עכו"ם או ישראל (ב"י בשם מרדכי פ' חזקת) ויש מי שכתב שהוא חרם ר"ג שלא להסיג גבול בשכירות בתים מן עכו"ם וה"ה במקום שנהגו לשכור ההלואה מן העכו"ם (מהר"מ פדואה סי' מ"א):

One who is seeking out a thing to buy it, and another forestalled him and bought it; it contains two se'ifim. One who is seeking out a thing to buy it or to hire it, whether land or movables, and another came and bought it, is called wicked; and the same law applies to one who wishes to hire himself out to another. And some say that if he came to acquire ownerless property, or to receive a gift from another, and another came and forestalled him, he is not called wicked, since it is not a thing available to him in another place (and one who buys land on the border of his fellow's, even though the law of the adjoining owner does not apply to it — the adjoining owner may forestall him and buy it, and he is not called wicked, for it is like a find) (Beit Yosef in the name of Mordechai, the first chapter of Bava Metzia) (and likewise if one is buying a thing and his fellow came and can buy it cheaply, in such a way as he does not find to buy it elsewhere, it is like a find, and he may buy it so long as the buyer has not acquired it) (a responsum of Maharadach, bayit 31). And some say that there is no difference. Hagah [Rema]: And the first opinion appears the principal one. And even according to this opinion, that is specifically with a poor man, but with a rich man not — unless it is (a thing) that is not available, for then even with a rich man he is called wicked (the Ran there, in the name of the Ramban, chapter "One who says" in Kiddushin). And see above, siman 156, se'if 5. And all this speaks only where they had already settled the price between them and nothing was lacking but the kinyan (a formal act of acquisition); but if the settling of the price is still lacking, in that the seller wants so much and the buyer wants it cheaper, another is permitted to buy it, whether the seller is a gentile or an Israelite (Beit Yosef in the name of Mordechai, chapter "The presumption of houses"). And there is one who wrote that it is a cherem (the severer form of the ban) of Rabbeinu Gershom not to encroach upon another's boundary in the renting of houses from a gentile; and the same law applies in a place where they are accustomed to hire the lending from the gentile (Maharam Padua, siman 41).

אסור למלמד להשכיר עצמו לבע"ה שיש לו מלמד אחר בביתו אם לא שיאמר הבע"ה אין רצוני לעכב המלמד שלי אבל אם שכר בעל הבית מלמד אחד יכול בעל הבית אחר לשכור אותו מלמד עצמו:

A teacher is forbidden to hire himself out to a householder who has another teacher in his house, unless the householder says: it is not my wish to keep my teacher. But if one householder hired a teacher, another householder may hire that same teacher.
