Se’if 1א׳
עכו"ם שאנס קרקע מישראל או בעלילות דברים. ובו ט סעיפים: העכו"ם המציקים לישראל ומבקשים להרגן עד שיפדה עצמו מיד עכו"ם בשדהו או בביתו ויתננה למציק ואחר כך יניחנו כשירצה המציק למכור אותה הקרקע אם יש ביד הבעלים ליקח מיד המציק הן קודמין לכל אדם ואם אין ביד הבעלים ליקח או ששהתה הקרקע ביד המציק י"ב חדש כל הקודם ולקח מהמציק זכה ובלבד שיתן לבעלי' הראשונים רביע הקרקע או שליש המעות מפני שזה המציק מוכר בזול הואיל וקרקע שאינו שלו הוא מוכר ה"ז מוכר בפחות רביע או קרוב לו וזה רביע של בעלים שהרי מחמת שהיא שלהם מוכר בזול לפיכך הלוקח מהמציק בשלשים נותן לבעלים עשרה או נותן להם רביע הקרקע ואחר כך יקנה הכל ואם לא נתן הרי הרביע כגזל בידו: הגה היו הבעלים אומרים שהיה בידם ליקח והלוקח אומר שלא היה בידם ליקח על הבעלים להביא ראיה דקרקע בחזקת הלקוחות (ר"ן פ' הנזקין) וי"א דכל זה כשנתנו לו הבעלים קרקע מעצמן כדי שלא יהרגנו אבל אם לקחן האנס מידן בחזקה הקרקע חוזרת לבעליה והם נותנים ללוקח מה שנהנו (ריב"ש סי' ר"צ ופסקי מהרא"י סי' ס"ט) וכמו שיתבאר לקמן ס"ח ישראל שדחקו חביריהם בתפיסה וגזמו להם להרגן עד שהוצרכו ליתן להם אין להם דין זה שהרי ידעו דאין ישראל שופכי דמים וגזמי ולא עבדי והוי כמי שלא היה בידן להרגן (מרדכי פרק הניזקין) כמו שיתבאר סעיף ח':
A gentile who seized land from an Israelite by force, or by false accusations; it contains nine se'ifim. The gentiles who oppress Israelites and seek to kill them, until one redeems himself from the gentile's hand with his field or with his house, and gives it to the oppressor, and afterwards he lets him go — when the oppressor wishes to sell that land, if the owners have the means to buy from the oppressor, they come before everyone. And if the owners do not have the means to buy, or the land remained in the oppressor's hand twelve months, whoever comes first and buys from the oppressor has acquired; provided that he gives the original owners a quarter of the land or a third of the money. For this oppressor sells cheaply: since he is selling land that is not his, he sells at a quarter less, or near it; and this quarter belongs to the owners, for it is because it is theirs that he sells cheaply. Therefore one who buys from the oppressor for thirty gives the owners ten, or gives them a quarter of the land, and afterwards he acquires all of it; and if he did not give it, the quarter is as robbery in his hand. Hagah [Rema]: If the owners were saying that they had the means to buy, and the buyer says that they did not have the means to buy, the owners must bring proof, for the land is in the presumption of the purchasers (the Ran, chapter "Those who are damaged"). And some say that all this is where the owners gave him the land of their own accord, so that he should not kill them; but if the violent man took it from their hand by force, the land returns to its owners, and they give the buyer what they benefited (Rivash, siman 290, and Piskei Maharai, siman 69), and as will be explained below, se'if 8. Israelites whose fellows pressed them by imprisonment and threatened to kill them, until they had to give to them — this law does not apply to them; for they knew that Israelites do not shed blood, and threaten but do not act, and it is as though it was not in their power to kill them (Mordechai, chapter "Those who are damaged"), as will be explained in se'if 8.
Se’if 2ב׳
אם אינו מאמין לו בכמה קנאה וגם אין לו עדים בכמה קנאה ישבע לו בכמה קנאה:
If he does not believe him as to how much he bought it for, and he also has no witnesses as to how much he bought it for, he swears to him how much he bought it for.
Se’if 3ג׳
אם קנה מעכו"ם תוך י"ב חדש אם ירצו הבעלים צריך להחזירה להם ויתן לו כמו שקנא' מעכו"ם ואם ירצו יניחוהו בידו ויתן להם שליש ממה שנתן לעכו"ם:
If he bought it from the gentile within twelve months — if the owners wish, he must return it to them, and they give him as much as he bought it for from the gentile; and if they wish, they leave it in his hand and he gives them a third of what he gave the gentile.
