קטן וחרש ושוטה ושכור מתי מוכר מטלטלין והקונה בשבת וביום טוב. ובו כח סעיפים: קטן עד שש שנים אין הקנייתו לאחרי' כלום ומשש שנים עד שיגדיל אם יודע בטיב משא ומתן (דהיינו שבדקוהו ומצאוהו שיודע ולאחר עשרה כל שאינו שוטה) (טור) מקחו מקח וממכרו ממכר ומתנתו קיימת בין בדבר מרובה בין בדבר מועט בין במתנת בריא בין במתנת שכיב מרע ודבר זה מתקנת חכמים והכל במטלטלים (וי"א הואיל ואינו רק מכח תקנת חכמים א"כ במקום שעשו שלא כהוגן כגון שמכרו בנכסים מועטים שזכו בהן הבנות מכירתן לאו כלום הוא) (תשובת הר"ן סי' מ"ט) אבל בקרקע אינו מוכר ולא נותן עד שיגדיל (דהיינו שהקטן בן י"ג והקטנה בת י"ב והביאו שערות) (הרמב"ם) ואפי' הוא קרקע שניתן לו במתנה או שקנה לו האפוטרופס ואם נתנו אפי' במתנת שכיב מרע אינו כלום אפילו הוא קרקע שניתן לו ואע"פ שהוא יודע בטיב משא ומתן (מיהו כ"ז שחפץ הקטן במה שעשה ואין קרוביו או הב"ד בטלו מעשיו והלוקח אכל פירות קרקע שלקח א"צ לשלם מה שלקח) (תשובת רמב"ן סי' ב') ואם ירש מאביו שטר חוב דינו כמטלטלים ויכול למוכרו או ליתנו לאחר:

A minor, a deaf-mute, one who is not of sound mind and a drunkard: when they sell movables; and one who acquires on the Sabbath and on a festival; it contains twenty-eight se'ifim. A minor up to six years — his transfer to others is nothing. And from six years until he comes of age, if he understands the nature of commerce (that is, they examined him and found that he understands; and after ten, whoever is not of unsound mind) (Tur), his purchase is a purchase, his sale is a sale and his gift stands, whether in a large matter or a small one, whether as the gift of a healthy person or as the gift of a person dangerously ill; and this matter is an enactment of the Sages, and all of it with movables (and some say that since it is only by force of the enactment of the Sages, then where they acted improperly — for instance they sold of a small estate, which the daughters have acquired — their sale is nothing) (Responsum of the Ran, siman 49). But with land he does not sell and does not give until he comes of age (that is, the boy thirteen and the girl twelve, and they have produced hairs) (the Rambam), even if it is land that was given him as a gift, or that the guardian bought for him. And if he gave it, even as the gift of a person dangerously ill, it is nothing, even if it is land that was given him, and even though he understands the nature of commerce (however, so long as the minor is content with what he did, and his relatives or the court did not cancel his acts, and the buyer ate the produce of the land that he bought, he need not pay for what he took) (Responsum of the Ramban, siman 2). And if he inherited a document of debt from his father, its law is as movables, and he can sell it or give it to another.

בד"א בקטן שאין לו אפוטרופוס אבל אם היה לו אפוטרופוס אין מעשיו כלום אפילו במטלטלים אלא מדעת האפוטרופוס שאם רצה לקיים מקחו וממכרו ומתנתו במטלטלים קיים: הגה והוא הדין אם סמוכים אצל בעל הבית שדינו כאפוטרופוס כמו שיתבאר לקמן סי' ר"צ אבל משהגדיל אע"פ שיש לו אפוטרופוס שמינהו לו אביו מקחו מקח וממכרו ממכר (ריב"ש סי' קמ"א וסי' קצ"ח) אע"פ שאפוטרופוס צריך לקיים דברי המת ואסור ליתנם ליורש ולא ללוקח עד הזמן שציוה מ"מ מקחו מקח ואם תפסן הלוקח מיד אין מוציאין מידו (ר"ן סוף פרק מציאת האשה):

When is this said? With a minor who has no guardian; but if he has a guardian, his acts are nothing, even with movables, except with the guardian's consent; for if he wishes to uphold his purchase, his sale and his gift with movables, it stands. Hagah [Rema]: And the same law applies if they are supported by a householder, whose law is as a guardian, as will be explained below, siman 290. But once he has come of age, even though he has a guardian whom his father appointed for him, his purchase is a purchase and his sale is a sale (Rivash, siman 141 and siman 198); although the guardian must carry out the words of the dead man, and is forbidden to give them to the heir, or to the buyer, until the time that he commanded, nevertheless his purchase is a purchase, and if the buyer seized them, they do not take them out of his hand (the Ran, end of chapter "What a wife finds").

קטן היודע בטיב משא ומתן שאין לו אפוטרופוס שנשא ונתן במטלטלים וטעה דינו כדין הגדול פחות משתות מחילה שתות מחזיר אונאה יתר על שתות בטל מקח:

A minor who understands the nature of commerce, who has no guardian, who dealt in movables and erred — his law is as the law of an adult: less than a sixth is a waiver; a sixth, he returns the overreaching; more than a sixth, the sale is void.
