Choshen Mishpat 234

Siman 234 of 427 in Choshen Mishpat — 4 se'ifim

Ona'ah· siman 234

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

One who sells a forbidden thing and the buyer ate it; it contains four se'ifim. One who slaughters the firstling and sold it, and it became known that he had not shown it to an expert — what he ate, he ate, and he returns him the money; and what remains of the meat in the hands of the purchasers shall be buried, and he returns them the money.

Se’if 2ב׳

And likewise one who slaughters a cow and sold it, and it became known that it is a tereifah (an animal with a fatal defect) — what they ate, they ate, and he returns them the money; and what they did not eat, they return him the meat and he returns them the money. And if the purchasers sold this tereifah meat to a gentile, or fed it to dogs, they reckon with the butcher over the value of the tereifah, and the butcher returns them the remainder. And such is the law of everyone who sells a thing whose eating is forbidden by Torah law.

Se’if 3ג׳

However, one who sells to his friend something that is prohibited to eat from the Rabbis, if they were fruit that existed, he returns the fruit and receives his money. If he ate them, then he ate them and the seller does not return anything to him.
