Se’if 1א׳
המוכר לחבירו חטים או שעורים או פירות כמה פסולת צריך לקבל הלוקח. ובו ב סעיפים: המוכר חטים לחבירו מקבל עליו רובע קטניות לכל סאה שעורים מקבל עליו רובע נישובית לסאה עדשים מקבל עליו רובע עפרורית לסאה תאנים מקבל עליו עשר מתליעות לכל מאה (וה"ה אחד לכל עשרה) (טור) מכר לו שאר פירות מקבל עליו רובע טינופת לכל סאה נמצא בהם יתר על השיעורים האלו כל שהוא ינפה הכל ויתן לו פירות מנופים וברורים שאין בהם כלום: הגה י"א דדוקא בדלא ידעינן (שלא) ערבן אבל אם ידוע שהמוכר לא ערבן צריך לקבל (אלו) השיעורים והמותר ינכה לו (טור) וי"א דבידוע שלא ערבן צריך לקבל עליו הכל (טור בשם רשב"ם) וי"מ דכל זה שמוכר לו פירות סתם או שאמר פירות יפות אלו אבל אמר פירות אלו ולא אמר יפות צריך לקבלן כמו שהן ואם אמר פירות יפות ולא אמר אלו נותן פירות שכולן יפות (טור בשם הרמ"ה):
One who sells his fellow wheat, barley or produce: how much refuse the buyer must accept; it contains two se'ifim. One who sells wheat to his fellow — the buyer accepts a quarter-kav of pulse for every se'ah; barley — he accepts a quarter-kav of chaff per se'ah; lentils — he accepts a quarter-kav of dust per se'ah; figs — he accepts ten wormy ones in every hundred (and the same law applies to one in every ten) (Tur). If he sold him other produce, he accepts a quarter-kav of dirt for every se'ah. If more than these measures was found in them, by any amount, he sifts the whole and gives him produce sifted and clean, with nothing in it. Hagah [Rema]: Some say, specifically where we do not know (that he did not) mix them in; but if it is known that the seller did not mix them in, he must accept (these) measures, and the excess he deducts for him (Tur). And some say that where it is known that he did not mix them in, he must accept all of it (Tur in the name of the Rashbam). And some explain that all this is where he sells him produce without specification, or said: these fine produce; but if he said: this produce, and did not say "fine", he must accept it as it is; and if he said: fine produce, and did not say "these", he gives produce that is all fine (Tur in the name of the Ramah).
Se’if 2ב׳
אין כל הדברים האלו אמורים אלא במקום שאין שם מנהג אבל במקום שיש להם מנהג הכל כמנהג המדינה יש מקומות שנהגו שיהיו כל הפירות מנוקים וברורים מכל דבר ושיהיו היינות והשמנים צלולים ולא ימכרו השמרים כלל ויש מקומות שנהגו אפי' היה בהם מחצה שמרים או שהיו בפירות עפר או תבן או מין אחר ימכור כמות שהוא ולפיכך הבורר (צרור) מתוך גורנו של חבירו נותן לו דמי חטים כשיעור צרור שברר שאילו הניחו היה נמכר במדת חטים ואם תאמר יחזירנה הרי אמרו אסור לערב כל שהוא:
All these things are said only in a place where there is no custom; but in a place where they have a custom, all is according to the custom of the country. There are places where the custom is that all produce should be cleaned and sifted of everything, and that wines and oils should be clear, and they do not sell the lees at all; and there are places where the custom is that even if there were half lees in them, or there was dust or straw or another kind in the produce, he sells it as it is. And therefore one who picks out (a pebble) from his fellow's threshing-floor gives him the value of wheat for the amount of the pebble that he picked out; for had he left it, it would have been sold at the measure of wheat. And if you say: let him put it back — they have said: it is forbidden to mix in any amount.
