Se’if 1א׳

המוכר שדה שלא באחריות או יצא עליו קול ערעור. ובו ו סעיפים: ראובן שמכר שדה לשמעון שלא באחריות ובא לוי והוציאה מיד שמעון אם רצה ראובן לעשות דין עם לוי עושה ואין לוי יכול לומר מה לי ולך והרי אין עליך אחריות שהרי ראובן אומר לו אין רצוני שיהיה לשמעון תרעומת עלי שהפסיד בגללי (אבל אם נתן לו במתנה לא יוכל לטעון בעדו דהא ליכא כאן תרעומת) (ב"י בשם הרשב"א):

One who sells a field without liability, or a rumour of a challenge went out about it; it contains six se'ifim. Reuven sold a field to Shimon without liability, and Levi came and took it out of Shimon's hand — if Reuven wishes to go to law with Levi, he does so, and Levi cannot say: what have I to do with you, since there is no liability on you? For Reuven says to him: I do not want Shimon to have a grievance against me, that he lost because of me (but if he gave it to him as a gift, he cannot plead on his behalf, for there is no grievance here) (Beit Yosef in the name of the Rashba).

Se’if 2ב׳

ראובן שמכר שדה לשמעון שלא באחריות וחזר ולקחה משמעון באחריות ובא ב"ח של ראובן לטרוף אותה ממנו אינו יכול לחזור על שמעון שאע"פ שלא קיבל עליו אחריות לשמעון אחריות עצמו קבל שלא יהי' הוא המוכר והוא המוציא לעצמו אבל אם בא ב"ח של יעקב אביו וטרפה מיד ראובן חוזר וגובה כל הדמים משמעון:

Reuven sold a field to Shimon without liability, and then bought it back from Shimon with liability, and a creditor of Reuven came to seize it from him — he cannot turn back against Shimon; for although he did not accept liability towards Shimon, he accepted liability for his own acts, that he should not be the seller and also the one who takes it out for himself. But if a creditor of Yaakov his father came and seized it from Reuven's hand, he turns back and collects all the money from Shimon.

המוכר שדה לחבירו שלא באחריות חייב באחריות דנפשיה ודוקא בזכות שיש לו בשעת מכירה אבל אם בא לו זכות לאחר מכאן חוזר עליו:

One who sells a field to his fellow without liability is bound by liability for his own acts; and this is specifically as to a right that he had at the time of the sale; but if a right came to him after that, he turns back against him.

Se’if 5ה׳

המוכר קרקע לחבירו ואחר שקנה הלוקח בא' מהדרכים שקונים בהם קודם שישתמש בה יצאו עליו מערערין ה"ז יכול לחזור בו שאין לך מום גדול מזה שעדיין לא נהנה בו ובאו התובעים לפיכך יבטל המקח ויחזיר המוכר את הדמים ויעשה דין עם המערערים ואם נשתמש בה הלוקח כל שהוא ואפי' דש אמצר שלה ועירבו עם הארץ אינו יכול לחזור בו אלא עושה דין עם המערער ואם הוציאה מידו בדין יחזור על המוכר כדין כל הנטרפין: הגה כל זה מיירי בערעור שלא נתברר עדיין לגמרי אבל ב"ד רואין שיש אמתלא בדברי המערער אבל אם לא יצא רק קול בעלמא אפי' לא נתקיים המקח לגמרי לא יכול לבטל המקח בשביל דברים בעלמא (טור) ואם חזר הלוקח מחמת ערעור אע"פ שנתבטל הערעור אח"כ נתבטל המקח ושניהן יכולין לחזור בו אם בא ערעור על השדה מחמת שהמוכר היה חייב לאחרים והמוכר אומר שיש לו שוברים על החובות מקרי ערעור ויכול הלוקח לחזור בו וא"צ לקנות דבר ולשמור שוברו לעולם (שם בשם הרא"ש):

One who sells land to his fellow, and after the buyer acquired by one of the ways by which one acquires, before he used it, challengers came out against it — he can retract; for you have no greater defect than this, that he has not yet had benefit of it and the claimants have come. Therefore the sale shall be cancelled, and the seller shall return the money and go to law with the challengers. And if the buyer used it to any extent, even if he trod on its boundary and mixed it with the ground, he cannot retract, but goes to law with the challenger; and if he took it out of his hand by law, he turns back against the seller, as the law of all whose property is seized. Hagah [Rema]: All this speaks of a challenge that has not yet been fully clarified, but where the court sees that there is some plausible ground in the challenger's words; but if only a mere rumour went out, then even if the sale had not been fully completed, he cannot cancel the sale on account of mere words (Tur). And if the buyer retracted on account of a challenge, then even though the challenge was afterwards cancelled, the sale has been cancelled, and both of them can retract. If a challenge came upon the field because the seller owed others, and the seller says that he has receipts for the debts, it is called a challenge, and the buyer can retract; and he need not buy something and guard his receipt for ever (there, in the name of the Rosh).
