Se’if 1א׳
אם קבל עליו כל אונס שאירע או התנה בפירוש שלא יהיה עליו אחריות. ובו ו סעיפים: כל המוכר קרקע או עבד או מטלטלין הרי זה חייב באחריותן כיצד אם בא אחד והוציא המקח מיד הלוקח מחמת המוכר חוזר הלוקח ונוטל כל הדמים שנתן מן המוכר שהרי נלקח המקח מחמתו כך הדין בכל ממכר אע"פ שלא פירש הלוקח דבר זה אלא קנה סתם אפילו מכר הקרקע בשטר ולא הזכיר בו אחריות ה"ז חייב באחריות שאחריות שלא נזכר טעות סופר הוא:
If he accepted upon himself every mishap that should occur, or stipulated expressly that there should be no liability upon him; it contains six se'ifim. Whoever sells land, or a slave, or movables is bound by liability for them. How so? If someone came and took the goods out of the buyer's hand on account of the seller, the buyer turns back and takes from the seller all the money that he gave, for the goods were taken on his account. So is the law with every sale, even though the buyer did not specify this matter but bought without specification; even if he sold the land by a document and did not mention liability in it, he is bound by liability, for liability that was not mentioned is a scribal error.

בד"א כשהוציא המקח מיד הלוקח בב"ד של ישראל כגון שהיה המקח מטלטלין והיו גנובים או גזולין או שהיתה הקרקע גזולה או שבא בעל חוב של מוכר וטרפה מיד הלוקח והכל בב"ד של ישראל אבל אם עכו"ם הוא שהוציא המקח מהלוקח בין בדין המלך בין בערכאות שלהם אין המוכר חייב באחריותו ואע"פ שהעכו"ם טוען שהמוכר גנב חפץ זה או גזלו ממנו והביא עידי עכו"ם על כך אין המוכר חייב כלום שזה אונס הוא ואין המוכר חייב באחריות אונס:
When is this said? When he took the goods out of the buyer's hand in a court of Israel — for instance the goods were movables and they were stolen or robbed, or the land was robbed, or a creditor of the seller came and seized it from the buyer's hand — and all in a court of Israel. But if it was a gentile who took the goods from the buyer, whether by the king's law or in their courts, the seller is not bound by liability for it; and even though the gentile pleads that the seller stole this article or robbed it from him, and brought gentile witnesses to this, the seller is not bound for anything, for this is a mishap, and the seller is not bound by liability for a mishap.

בד"א בשלא התנה עמו אבל אם התנה עמו שכל אונס שיולד בקרקע זה יהיה חייב לשלם אפי' בא עכו"ם וגזלה מחמת המוכר חייב לשלם אבל אם נפסק הנהר שהי' משקה אותה או שחזר הנהר לעבור בתוכה ונעשית בריכה או שבאה זועה והשחית אותה ה"ז פטור שאלו וכיוצא בהן אונס שאינו מצוי הוא ולא עלה על לב המוכר דבר זה הפלא בעת שהתנה וה"ה לכל תנאי ממון שאומדים דעת המתנ' ואין כוללין באותו תנאי אלא דברים הידועים שבגללן היה התנאי והם שהיו בדעת המתנה בעת שהתנה:
When is this said? Where he did not stipulate with him; but if he stipulated with him that for every mishap that should occur to this land he would be bound to pay, then even if a gentile came and robbed it on account of the seller, he is bound to pay. But if the river that watered it was cut off, or the river turned to pass through it and it became a pool, or an earthquake came and ruined it, he is exempt; for these and the like are an uncommon mishap, and this extraordinary thing did not enter the seller's mind at the time he stipulated. And the same law applies to every monetary condition: they estimate the mind of the one who stipulates, and include in that condition only the known things on account of which the condition was made, and which were in the mind of the one who stipulated at the time he stipulated.
