המחליף פרה בחמור או שקנה ונמצא נקב בבית הכוסות. ובו ב סעיפים: כל מי שנולד ספק ברשותו עליו להביא ראיה כיצד המחליף פרה בחמור ומשך בעל החמור את הפרה ולא הספיק בעל הפרה למשוך החמור עד שמת החמור על בעל החמור להביא ראיה שהי' חמורו קיים בשעת משיכת הפרה וכן כל כיוצא בזה: הגה וי"א דעל בעל הפרה להביא ראיה דמאחר שקנה החמור בכל מקום שהוא הרי היה ברשות בעל הפרה ועליו להביא ראיה כמו שיתבאר בסמוך לענין טבח (טור בשם הרא"ש) ואם אינו מביא ראיה ישבע המוכר שלא ידע המומין אלו ופטור (מרדכי פרק המדיר) ראובן החליף עם שמעון סוס ביין וכאשר משך שמעון הסוס בא עכו"ם ולקחו ממנו ואמר שהסוס נגנב ממנו ורוצה שמעון להחזיק ביין שבידו אם ראובן מודה שנגנב הסוס הוי מקח טעות ויוכל שמעון להחזיק מה שבידו אבל אם ראובן אינו מודה אמרינן העכו"ם משקר וצריך לתת היין לראובן (מרדכי פרק הזהב ותשובת מיימוני דקנין סימן ו'):
One who exchanges a cow for a donkey, or who bought and a perforation was found in the reticulum; it contains two se'ifim. Whoever has the doubt arise in his domain must bring proof. How so? One who exchanges a cow for a donkey, and the owner of the donkey drew the cow, and the owner of the cow had not managed to draw the donkey before the donkey died — the owner of the donkey must bring proof that his donkey was alive at the time the cow was drawn; and so in every case like this. Hagah [Rema]: And some say that the owner of the cow must bring proof, for since he acquired the donkey wherever it is, it was in the domain of the owner of the cow, and he must bring proof, as will be explained just below with regard to a butcher (Tur in the name of the Rosh). And if he does not bring proof, the seller swears that he did not know of these defects, and is exempt (Mordechai, chapter "One who imposes a vow"). Reuven exchanged a horse for wine with Shimon, and when Shimon drew the horse, a gentile came and took it from him and said that the horse had been stolen from him, and Shimon wants to keep hold of the wine that is in his hand — if Reuven admits that the horse was stolen, it is a mistaken sale, and Shimon can keep hold of what is in his hand; but if Reuven does not admit it, we say that the gentile is lying, and he must give the wine to Reuven (Mordechai, chapter "The gold", and Teshuvot Maimoniyot, Kinyan, siman 6).

מחט שנמצא בעובי בית הכוסות ונקבה אותו נקב מפולש אם נמצא עליה קורט דם בידוע שזו נטרפה קודם שחיטה לפיכך אם הגליד (פי' עור דק שעלה על המכה ערוך ורש"י פירש קרושט"א) פי המכה בידוע שזו נטרפה שלשה ימים קודם שחיטה לא הגליד פי המכה הרי זה ספק ועל הטבח להביא ראיה שקודם לקיחתו נטרפה שהרי ברשותו נולד הספק ואם לא הביא ראיה ישלם הדמים למוכר:
A needle that was found in the thickness of the reticulum, and it had pierced it with a perforation right through: if a drop of blood is found on it, it is known that this animal became a tereifah (an animal with a fatal defect) before the slaughter. Therefore if the mouth of the wound had formed a crust (that is, a thin skin that grew over the wound — Aruch; and Rashi explained it as crosta), it is known that it became a tereifah three days before the slaughter. If the mouth of the wound had not formed a crust, it is a doubt, and the butcher must bring proof that it became a tereifah before he bought it, for the doubt arose in his domain; and if he did not bring proof, he pays the price to the seller.
