Se’if 1א׳
שנים חלוקים על המקח ושאד טענות שבין המוכר והלוקח. ובו ד סעיפים: נאמן בעל המקח לומר לזה מכרתי ולזה לא מכרתי אימתי בזמן שהמקח יוצא מתחת ידו אבל אם אין המקח יוצא מתחת ידו הרי הוא עד א' בלבד ודינו בעדות זו כדין כל אדם שהרי אינו נוגע בעדותו (לא שנא נקט זוזי מחד לא שנא נקט זוזי משנים ואמר שאחד מהם נתן לו בעל כרחו (טור) ולפיכך אם נטל הדמים משנים ונטל מאחד מדעתו ומאחד בעל כרחו ולא ידע ממי נטל מדעתו וממי נטל בעל כרחו בין שהיה המקח בידו בין שהיו שניהם תופסים בו אין כאן עדות כלל וכל אחד מהם נשבע כתקנת חכמים בנקיטת חפץ ונוטל חצי המקח וחצי הדמים:
Two who dispute over a purchase, and other pleas between the seller and the buyer; it contains four se'ifim. The owner of the goods is believed to say: to this one I sold, and to that one I did not sell. When? When the goods go out from under his hand; but if the goods do not go out from under his hand, he is only a single witness, and his law in this testimony is as the law of any person, for he has no interest in his testimony (it makes no difference whether he took money from one, or took money from two and said that one of them gave it to him against his will) (Tur). And therefore, if he took the price from two, and took from one with his consent and from one against his will, and does not know from whom he took with his consent and from whom he took against his will — whether the goods were in his hand or both of them were holding on to them — there is no testimony here at all, and each of them swears according to the enactment of the Sages, while holding a sacred object, and takes half the goods and half the price.
Se’if 2ב׳
הלוקח מאחד מחמשה בני אדם וכל אחד מהם תובע אותו ואומר אני הוא בעל המקח והוא אינו יודע ממי מהם לקח מניח דמי המקח ביניהם ומסתלק ויהיו הדמים מונחים בבית דין עד שיודו או עד שיבא אליהו ואם הוא חסיד נותן דמים לכל א' וא' כדי לצאת ידי שמים:
One who bought from one of five people, and each of them claims of him and says: I am the owner of the goods, and he does not know from which of them he bought — he leaves the price of the goods among them and withdraws, and the money shall lie in the court until they admit, or until Elijah comes. And if he is a pious man, he gives the price to each and every one, so as to fulfil his duty to Heaven.
Se’if 3ג׳
לקח מקח מאחד מחמשה בני אדם וכפר בו ונשבע על שקר ועשה תשובה והרי הוא רוצה לשלם וכל א' ואחד תובע אותו ואומר אני הוא שכפרת בי ונשבעת על שקר והוא אומר איני יודע חייב לשלם לכל אחד ואחד מפני שעבר עבירה:
If he took goods from one of five people, and denied it and swore falsely, and repented, and now he wishes to pay, and each and every one claims of him and says: I am the one whom you denied and to whom you swore falsely — and he says, I do not know — he must pay each and every one, because he committed a transgression.
