Se’if 1א׳

המוכר שדה ואמר חוץ מדקל פלוני או חוץ מהאילנות או קרקע לזה ואילנות לזה (וכיצד יכתוב בשטר מכירה כדי להסתלק מן העירעורים). ובו יד סעיפים:' המוכר פרדס לחבירו צריך שיכתוב לו קנה לך דקלים ותמרים והוצין (פי' ענפי דקל שעושין מהן מחיצה) ואע"פ שקנה כל אלו אע"פ שלא פירש אותם נויי השטר הוא:

One who sells a field and said: except for such-and-such a palm, or: except for the trees; or land to one and trees to another (and how he should write in a document of sale so as to be clear of challenges); it contains fourteen se'ifim. One who sells an orchard to his fellow must write him: acquire for yourself palms, dates and palm-fronds (that is, branches of the palm of which they make a partition); and although he acquires all these even if he did not specify them, it is an embellishment of the document.

Se’if 2ב׳

וכן המוכר קרקע לחבירו צריך לכתוב לו ולא הנחתי לפני במכר זה כלום כדי להסתלק מהדינין והטענות:

And likewise one who sells land to his fellow must write him: and I have kept back nothing for myself in this sale — so as to be clear of lawsuits and pleas.

Se’if 3ג׳

המוכר שדה לחבירו והיו בה דקלים וא"ל חוץ מדקל פלוני אם דקל טוב ומשובח הוא אותו הדקל לבדו שייר והשאר ללוקח ואם דקל רע הוא ששייר לא קנה מהדקלים כלום: הגה וי"א דדוקא הטובים ממנו לא קנה אבל כל אילנות הפחותים ממנו או אפי' כיוצא בו קנה וכל אילן הנושא קב פירות מקרי דקל טוב (טור והרא"ש) וי"א דכל זה במין האילן ששייר אבל כל שאינו מינו קנה הלוקח הכל (נ"י פ' המוכר הבית בשם רשב"א):

One who sells a field to his fellow, and there were palms in it, and he said to him: except for such-and-such a palm — if that palm is a good and choice palm, he reserved it alone, and the rest are the buyer's; and if the palm that he reserved is a poor one, he has acquired none of the palms. Hagah [Rema]: And some say that specifically those better than it he has not acquired, but all the trees inferior to it, or even like it, he has acquired; and every tree that bears a kav of fruit is called a good palm (Tur and the Rosh). And some say that all this is with the kind of tree that he reserved, but whatever is not of its kind the buyer has acquired, all of it (Nimukei Yosef, chapter "One who sells the house", in the name of the Rashba).
