המוכר בית סתם מה נמכר עמו. ובו יג סעיפים: המוכר דבר שיש לו תשמישים לא מכר את התשמישים אא"כ פירש כיצד מכר את הבית לא מכר את היציע שסביבות הבית אע"פ שהוא פתוח לתוכו (וי"א אפי' מכר לו מצרים החיצונים) (טור בשם הרא"ש וב"י ר"פ המוכר את הבית) בד"א כשהיה רוחב היציע ארבע אמות או יותר אבל פחות מזה הרי הוא בכלל הבית (אפי' אינו פתוח לתוכו) (טור) וכן העלייה שעל גבי הבית הפתוחה לתוכו בארובה (פי' כמו חלון שבגג הבית שהוא קרקעית העליה) במעזיבת הבית הרי הוא בכלל הבית: הגה וכל זה לא מיירי אלא בשעת המכר או מתנה אבל מי שהודה שמכר ביתו או נתנו לחבירו הכל בכלל דא"צ להודות רק על הכלל ולא על הפרטים (ב"י בשם רשב"א):
One who sells a house without specification: what is sold with it; it contains thirteen se'ifim. One who sells a thing that has appurtenances has not sold the appurtenances unless he specified them. How so? If he sold the house, he has not sold the annexe that is round about the house, even though it opens into it (and some say, even if he marked out the outer boundaries for him) (Tur in the name of the Rosh, and Beit Yosef, beginning of chapter "One who sells the house"). When is this said? When the annexe was four cubits wide or more; but if less than this, it is included in the house (even if it does not open into it) (Tur). And likewise the upper storey over the house that opens into it through a hatchway (that is, like a window in the roof of the house, which is the floor of the upper storey) in the plaster flooring of the house is included in the house. Hagah [Rema]: And all this speaks only of the time of the sale or the gift; but one who admitted that he had sold his house or given it to his fellow — everything is included, for he need admit only the whole and not the particulars (Beit Yosef in the name of the Rashba).

המוכר את הבית לא מכר את החדר שלפנים ממנו אע"פ שמצר לו מצרים החיצונים (וי"א דוקא בחדר שרחב ארבע אמות) (טור בשם הרא"ש וב"י בשם הרמב"ן) ולא את הגג בזמן שיש לו מעקה גבוה י' טפחים ויש לו רוחב ארבע אמות ולא את הבור (פי' בור בחפירה דות בבנין) ולא את הדות אע"פ שכתב לו שמכר לו עומקא ורומא (ואע"פ שמכר לו המצרים החיצונים): הגה וכתב לו ג"כ ולא שיירית בזבינא אילין כלום (טור) ויש חולקין אם כתב לו ולא שיירית וכו' (ר"ן וב"י פ' המוכר את הבית) וצריך המוכר לקנות לו דרך מהלוקח כדי להכנס לבור זה או לדות זה ששייר ואם א"ל מכרתי לך הבית חוץ מהבור או הדות אינו צריך לקנות לו דרך וכן המוכר בור או דות בלבד אין הלוקח צריך לקנות לו דרך אלא נכנס לתוך ביתו של מוכר עד הדות וממלא (בד"א שאין ללוקח דרך אחר חוץ מזה אבל אם יש לו דרך אחר אין לו דרך בביתו של מוכר) (ריב"ש סי' רמ"ח):
One who sells the house has not sold the room that is within it, even though he marked out the outer boundaries for him (and some say, specifically a room four cubits wide) (Tur in the name of the Rosh, and Beit Yosef in the name of the Ramban); nor the roof, when it has a parapet ten handbreadths high and it is four cubits wide; nor the pit (that is, a pit is dug, a cistern is built) nor the cistern, even though he wrote him that he sold him "its depth and its height" (and even though he sold him the outer boundaries). Hagah [Rema]: And even if he also wrote him: "and I have kept back nothing in this sale" (Tur); and some disagree where he wrote him "and I have kept back", etc. (the Ran, and Beit Yosef, chapter "One who sells the house"). And the seller must buy himself a way from the buyer in order to go in to this pit or this cistern that he reserved; and if he said to him: I have sold you the house except for the pit or the cistern, he need not buy himself a way. And likewise one who sells a pit or a cistern alone — the buyer need not buy himself a way, but goes in through the seller's house to the cistern and draws water (when is this said? where the buyer has no other way besides this one; but if he has another way, he has no way through the seller's house) (Rivash, siman 248).

המוכר בית לחבירו אע"פ שכתב לו הקניתי לך עמקו ורומו צריך לכתוב לו קנה מקרקע התהום עד רום רקיע שהעומק והרום אינה נקנה בסתם וכיון שקנה העומק והרום קנה הרום שהוא האויר בלבד והעומק שהוא עובי הארץ אבל לא קנה הבנינים שבעמקים ושבאויר וכיון שכתב לו מקרקע התהום עד רום הרקיע קנה הבור והדות שבעובי הקרקע ומעזיבות והמחילות שבין המעזיבות למעלה: הגה וגם הגג אע"פ שיש לו גובה עשרה ורוחב ד' אבל כל שאינו רוחב ד' וגובה י' בכלל בית הוא ואפי' לא כתב ליה עומקא ורומא קנה גג בזה (ב"י בשם רמב"ן):
One who sells a house to his fellow — even though he wrote him: I have transferred to you its depth and its height, he must write him: acquire from the bottom of the deep to the height of the sky; for the depth and the height are not acquired without specification. And once he has acquired the depth and the height, he has acquired the height, which is the air alone, and the depth, which is the thickness of the earth; but he has not acquired the structures that are in the depths and in the air. And once he has written him: from the bottom of the deep to the height of the sky, he has acquired the pit and the cistern that are in the thickness of the ground, and the plaster floorings, and the vaults that are between the plaster floorings above. Hagah [Rema]: And the roof too, even though it is ten high and four wide; but whatever is not four wide and ten high is included in the house, and even if he did not write him "its depth and its height", he has acquired the roof in this case (Beit Yosef in the name of the Ramban).
