Siman 213 of 427 in Choshen Mishpat — 2 se'ifim
Se’if 1א׳
The produce of a beehive and the produce of a dovecote: in what manner he acquires; it contains two se'ifim. One who sells his fellow the produce of a dovecote or the produce of a beehive — he has acquired, and this is not selling a thing that has not come into the world; for he is not selling doves that will be born or honey that will come into the hive, but is selling a dovecote for its produce or a hive for its honey. For he is as one who sells his fellow a water channel, who has the benefit of all that he catches in it; so this one has transferred this dovecote for its produce, as one sells a tree for its fruit.
Se’if 2ב׳
The eggs and the fledglings themselves that are in the dovecote — the owner of the dovecote does not acquire them so long as they have not flown; and this matter is an enactment of the Sages, and they touched upon it because of "you shall not take the mother with the young" (Deuteronomy 22:6). Therefore one who wishes to transfer these fledglings and eggs to his fellow claps (that is, strikes with his hand) on the dovecote until the mothers fly off and rise from the ground, and afterwards transfers them to his fellow by one of the ways of acquiring movables.
