Se’if 1א׳
דין מקנה דירת בית או חצירו או מקדיש דבר שלא בא לעולם. ובו ט סעיפים: אין אדם מקנה לא במכר ולא במתנה אלא דבר שיש בו ממש אבל דבר שאין בו ממש אינו נקנה לפיכך המקנה לחבירו אכילת פירות דקל זה או דירת בית זה לא קנה עד שיקנה גוף בית זה לדור בו וגוף אילן לאכול פירותיו: הגה האומר ידור פלוני בבית זה ולא קצב זמן הדירה אפי' רק שעה אחת במשמע (הג"מ סוף ב"ב) ושטר שכתוב בו שראובן נתן לדור בביתו וקנו ממנו ע"ז יש לפרש השטר שקנה ממנו בענין המועיל והקנה לו הגוף לדור בו וכ"ש אם החזירו הקנין למטה בשטר דודאי ליפוי כח כתבו וקנו ממנו בענין המועיל אבל אם לא כתב בשטר רק קנו ממנו שנותן לו לדור בביתו אינו כלום דאז עיקר הקנין קאי על הדירה ואין בדירה ממש (תשו' רמב"ן סי' ס"ז) שטר שלא היה כתוב בו קנין פירות כראוי רק כתוב בו שנתן לו כח ליקח הפירות כתקון חכמים הרי הודה שהקנה לו כתקון חכמים ויש לפרש שנתן לו באופן המועיל (מרדכי פ' מי שמת):
The law of one who transfers the dwelling in a house or in his courtyard, or who consecrates a thing that has not come into the world; it contains nine se'ifim. A man transfers, whether by sale or by gift, only a thing that has substance; but a thing that has no substance is not acquired. Therefore one who transfers to his fellow the eating of the fruit of this palm, or the dwelling in this house — he has not acquired, until he transfers the body of this house to live in it, and the body of the tree to eat its fruit. Hagah [Rema]: One who says: let so-and-so live in this house, and did not fix the term of the dwelling — even a single hour is implied (Hagahot Mordechai, end of Bava Batra). And a document in which it is written that Reuven gave him to live in his house, and they made a kinyan (a formal act of acquisition) from him on this — the document is to be interpreted that they made the kinyan from him in a manner that is effective, and that he transferred to him the body to live in it; and all the more so if the kinyan was repeated lower down in the document, for certainly they wrote it to strengthen his position, and made the kinyan from him in a manner that is effective. But if he wrote in the document only that they made a kinyan from him that he gives him to live in his house, it is nothing, for then the kinyan rests chiefly on the dwelling, and the dwelling has no substance (Responsa of the Ramban, siman 67). A document in which the kinyan of the produce was not written as it should be, but in which it was written that he gave him the power to take the produce according to the enactment of the Sages — he has thereby admitted that he transferred to him according to the enactment of the Sages, and it is to be interpreted that he gave it to him in a manner that is effective (Mordechai, chapter "One who died").
Se’if 2ב׳
וכן המוכר לחבירו אויר חורבתו ואויר חצירו אינו כלום אא"כ הקנה לו חצירו להכניס בו זיזין וכן כל כיוצא בזה:
And likewise one who sells his fellow the air of his ruin or the air of his courtyard — it is nothing, unless he transferred his courtyard to him to put projections into it; and so in every case like this.
Se’if 3ג׳
אבל אם מכר לא' בית ואילן וחורבה וחצר ושייר לעצמו דירת הבית ואכילת הפירות ואויר החורבה ואויר החצר מהני דהוי כאילו פירש ששייר לעצמו מקום ואפי' לא הזכיר שיור בחצר כלל אלא מכר לו בית ואמר לו על מנת שדיוטא העליונה שלי אמרינן ששייר לו מקום בחצר להוציא זיזין מהדיוטא לחצר: הגה ואם שייר לעצמו זכות וגם שייר לאיש אחר אמרינן כמו ששייר לעצמו בעין יפה ובאופן המועיל כן שייר לחבירו דודאי על ענין אחד נתכוין (תשו' רמב"ן סי' י"ח) (וע"ל סי' ר"ט ס"ז):
But if he sold to one a house, a tree, a ruin and a courtyard, and reserved for himself the dwelling in the house, the eating of the fruit, the air of the ruin and the air of the courtyard — it is effective, for it is as if he had specified that he reserved a place for himself. And even if he did not mention any reservation in the courtyard at all, but sold him a house and said to him: on condition that the upper storey is mine — we say that he reserved for himself a place in the courtyard to put out projections from the upper storey into the courtyard. Hagah [Rema]: And if he reserved a right for himself and also reserved one for another man, we say that just as he reserved for himself with a generous eye and in a manner that is effective, so he reserved for his fellow, for certainly he intended one thing (Responsa of the Ramban, siman 18) (and see above, siman 209, se'if 7).
