דין דבר שלא ברשותו והכותב נכסיו לבניו לאחר מותו. ובו ז סעיפים: דבר שאינו ברשותו של מקנה אינו נקנה והרי הוא כדבר שלא בא לעולם כיצד מה שאירש מאבא (או משאר מורישיו) (תלמידי הרשב"א) מכור לך מה שתעלה מצודתי מהים נתון לך שדה זו לכשאקחנה קנויה לך לא אמר כלום וכן כל כיוצא בזה: הגה וי"א דוקא בסתם אבל אם פי' ואמר שדה זו שאני אירש מאבא מכור לך קנה (טור בשם ר"ת) וע"ל סי' ר"ט סעיף ה':
The law of a thing not in his domain, and of one who writes his property over to his sons after his death; it contains seven se'ifim. A thing that is not in the domain of the one conveying is not acquired, and it is as a thing that has not come into the world. How? What I shall inherit from father (or from any other he inherits from) (the students of the Rashba) is sold to you; what my net will bring up from the sea is given to you; this field, when I buy it, is acquired to you — he has said nothing; and likewise in every case like this. Hagah [Rema]: And some say that this is specifically without specifying; but if he specified and said: this field that I shall inherit from father is sold to you, he has acquired (Tur in the name of Rabbeinu Tam); and see above, siman 209, se'if 5.
Se’if 2ב׳
מי שהיה מורישו גוסס (פי' מעלה ליחה בגרונו מפני צרות החזה שזה יקרה סמוך למיתה) ונטה למות ורצה למכור מנכסיו מעט כדי להוציא הדמים בצרכי קבורה הואיל והבן עני ואם ימתין עד שימות וימכר ישתהא המת ויתבזה תקנו חכמים שאם מכר ואמר מה שאירש מאבי היום מכור לך ממכרו קיים: הגה ואין מדקדקים אם מכר יותר מעט ואם לא מצא למכור מעט מוכר בכדי שיעור שמוצא למכור (ר"ן פ"ק דמציעא והמגיד פכ"ב דמכירה בשם רב האי וב"י בשם תלמידי רשב"א) וכן צייד עני שאין לו מה יאכל ואמר מה שתעלה מצודתי היום מן הים מכור לך ממכרו קיים משום כדי חייו:
One whose legator was a goses (that is, one who brings up phlegm in his throat because of the narrowing of the chest, which happens close to death) and was near to death, and he wished to sell a little of the property in order to spend the money on the needs of burial — since the son is poor, and if he waits until the father dies and then sells, the dead will be kept waiting and be disgraced — the Sages ordained that if he sold and said: what I shall inherit from my father today is sold to you, his sale stands. Hagah [Rema]: And they are not exacting if he sold a little more; and if he did not find a buyer for a little, he sells as much as he finds a buyer for (the Ran, chapter 1 of Bava Metzia; the Maggid, chapter 22 of the Laws of Sale, in the name of Rav Hai; and Beit Yosef in the name of the students of the Rashba). And likewise a poor fisherman who has nothing to eat, and said: what my net brings up from the sea today is sold to you — his sale stands, for the sake of his livelihood.

היה אביו נוטה למות ולא היה לו צרכי קבורה ומכר לאח' לצרכי קבורה ואמר ליה מה שאירש מאבא היום מכור לך בכך וכך ומת הבן בחיי האב ואח"כ מת האב בן הבן מוציא מיד הלקוחות ואינו צריך להחזיר דמים שהרי אביו מכר דבר שלא בא עדיין לרשותו ונמצאו הנכסים ברשות האב וזה יורש אבי אביו:
If his father was near to death and had nothing for the needs of burial, and he sold to another for the needs of burial and said to him: what I shall inherit from father today is sold to you for so much — and the son died in the father's lifetime, and afterwards the father died — the son's son takes it out of the hand of the purchasers and need not return the price; for his father sold a thing that had not yet come into his domain, so that the property is found to have been in the father's domain, and this one inherits his father's father.
