Se’if 1א׳
המקנה לעובר שלו או לעובר אחר. ובו ג סעיפים: אין אדם מקנה למי שלא בא לעולם לפיכך המזכה לעובר של אחר לא קנה ואפילו אמר לכשיולד יזכה: הגה ודלא כיש חולקין וסבירא להו דאם לא מת או חזר המזכה עד שיולד וקנאו במשיכה וישנו עדיין ברשות הזוכה כשיולד אז זכה אם אמר כשיולד (הרמ"ה וע"ל סי' רכ"ב טור בשם הרא"ש ור"ח) ואם היה בנו קנה אפילו לא אמר לכשיולד והוא שתהיה אשתו כבר מעוברת בשעת המתנה (ובן בנו כאחר דמי) (תשובת הרא"ש כלל פ"ב סי' ד') וי"א דהא דמזכה לעובר שלו קנה דוקא בשכ"מ אבל בבריא לא קנה:
One who conveys to his own unborn child or to another's unborn child; it contains three se'ifim. A person cannot convey to one who has not come into the world; therefore one who confers title on another's unborn child — it has not acquired, even if he said: when it is born, let it acquire. Hagah [Rema]: And not like those who disagree and hold that if the one conferring did not die or retract until it was born, and he had it acquired for it by drawing, and it is still in the domain of the one acquiring for it when it is born, it then acquires, if he said "when it is born" (the Ramah; and see below, siman 222; Tur in the name of the Rosh and Rabbeinu Chananel). And if it was his own son, it has acquired, even if he did not say "when it is born", provided that his wife was already pregnant at the time of the gift (and his son's son is as another) (a responsum of the Rosh, klal 82, siman 4). And some say that where one confers title on his own unborn child, it acquires specifically with a person dangerously ill; but with a healthy person, it does not acquire.
Se’if 2ב׳
הקנה מקצת נכסיו לבהמה או למי שלא בא לעולם וחזר ואמר לחבירו קנה כבהמה זו או כעובר זה לא קנה כלום:
If he conveyed part of his property to an animal, or to one who has not come into the world, and then said to his fellow: acquire like this animal, or like this unborn child — he has acquired nothing.
Se’if 3ג׳
א"ל קנה נכסי או חפץ פלוני אתה ובהמה זו או אתה ועובר זה קנה הוא מחצה: (המקנה דבר למת כל שהוא לצורך קבורתו וכבודו קנה) (תשו' רשב"א סי' שע"ה):
If he said to him: acquire my property, or such-and-such an article, you and this animal, or you and this unborn child — he has acquired half. One who conveys anything whatever to a dead person for the needs of his burial and his honour — it is acquired (a responsum of the Rashba, siman 375).
