המקנה דבר שאינו מסויים או שלא בא לעולם. ובו י סעיפים: המקנה לחבירו דבר שאינו מסויים אם היה מינו ידוע אע"פ שאין מדתו ומשקלו ידוע הרי זה קנה ואם אין מינו ידוע לא קנה כיצד ערימה זו של חטים אני מוכר לך בכך וכך מרתף זה של יין אני מוכר לך בכך וכך שק של תאנים אני מוכר לך בכך וכך אע"פ שאין מדת הערימה ידועה ולא מנין הקנקנים ולא משקל התאנים ידוע ה"ז ממכרו קיים אע"פ שנמצא חסר או יתר על האומד שהיה בדעתם ויש להם אונאה לפי שער שבשוק:

One who conveys a thing that is not defined, or that has not come into the world; it contains ten se'ifim. One who conveys to his fellow a thing that is not defined — if its kind was known, even though its measure and its weight are not known, he has acquired; and if its kind is not known, he has not acquired. How? This heap of wheat I sell you for so much; this cellar of wine I sell you for so much; a sack of figs I sell you for so much — even though the measure of the heap is not known, nor the number of the jars, nor the weight of the figs, his sale stands, even if it was found less or more than the estimate that was in their minds; and the law of overreaching applies to them according to the market rate.

אבל האומר לחבירו כל מה שיש בבית זה אני מוכר לך בכך וכך וכל מה שיש בתיבה זו או בשק זה אני מוכר לך בכך וכך ורצה הלוקח ומשך אין כאן קנין שלא סמכה דעתו של לוקח שהרי אינו יודע מה שיש בו אם תבן או זהב ואין זה אלא כמשחק בקוביא וכן כל כיוצא בזה: הגה וי"א דה"ה שנים שהחליפו על כל אשר להם וע"ל סוף סי' ר"ג וע"ל סי' רמ"א ס"ד מדין המוכר דבר שאינו מסויים:

But one who says to his fellow: all that is in this house I sell you for so much, or: all that is in this chest or in this sack I sell you for so much, and the buyer agreed and drew — there is no kinyan (a formal act of acquisition) here; for the buyer's mind did not rely on it, since he does not know what is in it, whether straw or gold; and this is nothing but like playing with dice; and likewise in every case like this. Hagah [Rema]: And some say that the same law applies to two who exchanged all that they have; and see above, end of siman 203; and see below, siman 241, se'if 4, on the law of one who sells a thing that is not defined.

המוכר לחבירו בעשרה דינרים חטים ולא פסק כמה סאה מכר לו נותן לו כשער שבשוק בשעת המכירה וכל החוזר בו מאחר נתינת הדמים ולא רצה בשער שהיה בשוק בשעת נתינת המעות מקבל מי שפרע:

One who sells his fellow wheat for ten dinars and did not fix how many se'ah he sold him gives him at the market rate at the time of the sale; and whoever retracts after the giving of the price, and did not want the rate that was in the market at the time the money was given, receives mi shepara (the curse pronounced upon one who retracts from a sale).
