Se’if 1א׳
המוכר נכסיו על תנאי ודיני אסמכתא והמחייב עצמו בדבר שאינו חייב בו. ובו כא סעיפים: המקנה לחבירו בין קרקע בין מטלטלים והתנה תנאים שאפשר לקיימם בין שהתנה המקנה בין שהתנה הקונה (מיהו י"א דאם התנה המוכר טובת הלוקח אין זה תנאי דלא הוי אלא פטומי מילי והני מילי שמכר לו בתחילה סתם וקודם שנגמר המקח לגמרי הטיל המוכר תנאי אבל אם בתחילה אמר המוכר על תנאי כך וכך אני מוכר לך אע"פ דהוי טובת הלוקח מ"מ לא קנה רק אדעתא דהכי והוי תנאי גמור וכן אם התנו תנאי ואח"כ כתבו השטר סתם ודאי על תנאי הראשון כתבוהו) (טור בשם הרא"ש והגהות מרדכי פ' איזהו נשך וב"י בשם תוס' ותלמידי רשב"א) אם נתקיימו התנאים נקנה הדבר שהוקנה ואם לא נתקיים התנאי לא קנה וכבר נתבאר משפטי התנאי בטור אבן העזר (סי' ל"ח וסי' קמ"ד וע"ל סי' רמ"א מדיני תנאי):
One who sells his property on a condition, and the laws of asmachta (an undertaking made to hang on a condition), and one who binds himself to something he does not owe; it contains twenty-one se'ifim. One who conveys to his fellow, whether land or movables, and stipulated conditions that can be fulfilled, whether the one conveying stipulated or the one acquiring stipulated (however, some say that if the seller stipulated something for the buyer's benefit, it is no condition, for it is nothing but mere words. And this applies where he sold to him at first without specifying, and before the sale was entirely completed the seller imposed a condition; but if at the outset the seller said: on such-and-such a condition I sell to you — even though it is for the buyer's benefit, nevertheless he acquired only on that understanding, and it is a complete condition. And likewise, if they stipulated a condition and afterwards wrote the document without specifying, they certainly wrote it on the first condition) (Tur in the name of the Rosh, and Hagahot Mordechai, chapter "Which is interest", and Beit Yosef in the name of the Tosafot and the students of the Rashba) — if the conditions were fulfilled, the thing that was conveyed is acquired; and if the condition was not fulfilled, he has not acquired. And the laws of the condition have already been explained in Tur Even HaEzer (simanim 38 and 144; and see below, siman 241, on the laws of conditions).
Se’if 2ב׳
י"א דה"מ כשקנה בדרך מהדרכים שקונים בהם והרי יש עליו לקיים התנאי אבל אם לא קנה עתה והתנה עמו שאם נתקיים התנאי הזה יקנה ואם לא נתקיים לא יקנה אע"פ שנתקיים התנאי לא קנה שזו אסמכתא היא ולא קניה אלא א"כ אמר לו קנה מעכשיו וקנו מידו על כך:
Some say that this applies where he acquired by one of the ways by which one acquires, and it is then upon him to fulfil the condition; but if he did not acquire now, and stipulated with him that if this condition is fulfilled he will acquire, and if it is not fulfilled he will not acquire — even though the condition was fulfilled, he has not acquired, for this is an asmachta and not an acquisition; unless he said to him: acquire from now, and they made a kinyan (a formal act of acquisition) from him on this.
Se’if 3ג׳
מי שמכר חצירו או שדהו ופירש בשעת המכירה שהוא מוכר כדי לילך למקום פלוני או מפני המטר שנמנע כדי לקנות חטים בדמיו ה"ז כמוכר על תנאי לפיכך אם ירד המטר אחר שמכר או באו חטים והוזלו או נמנע הדרך לעלות לאותה הארץ או לא נסתייע לו לעלות או לקנות החטים ה"ז מחזיר לו הדמים ותחזור לו הקרקע שהרי פירש שאינו מוכר אלא לעשות דבר פלוני והרי לא נעשה וכן כל כיוצא בזה: הגה ודוקא במוכר קרקעותיו אבל במוכר מטלטלים ל"מ גילוי דעתו עד שיתנה בדיני תנאי (טור בשם רש"י):
One who sold his courtyard or his field and specified at the time of the sale that he is selling in order to go to such-and-such a place, or because of the rain that was withheld, in order to buy wheat with its price — this is as one who sells on a condition. Therefore, if rain fell after he sold, or wheat arrived and became cheap, or the road to go up to that land was closed, or he did not succeed in going up or in buying the wheat — he returns him the price, and the land returns to him; for he specified that he was selling only in order to do such-and-such a thing, and it was not done; and likewise in every case like this. Hagah [Rema]: And specifically with one who sells his lands; but with one who sells movables, his revealing his mind does not avail unless he stipulates according to the laws of conditions (Tur in the name of Rashi).
