Se’if 1א׳

דין כשאמכור אמכור לך במאה ומכר לאחר ביותר או שאמר אמכרנה לך כמו שישומו אותו ב"ד. ובו ד סעיפים: האומר לחבירו כשאמכור שדה זו הרי היא מכורה לך מעכשיו במנה וקנה מידו על כך ולאחר זמן מכרה לאחר במאה קנה הראשון (לא הזכיר סכום רק א"ל כשאמכרנה אמכור לך (לא קנה הראשון) (טור) וכן אם) מכרה ביותר על מנה קנה האחרון שלא א"ל אלא כשאמכור שיהיה מוכר מדעתו כבתחלה וזה לא היה רוצה למכור ולא מכר אלא מפני התוספות שהוסיף זה ונמצא כמי שנאנס ומכר: הגה וכל זה מיירי שאמר בלשון כשאמכור אמכור לך וכו' אבל אמר לא תמכור אלא לי (מהרי"ק שורש כ') או שהתנה בפירוש שאף אם יתנו לו יותר ממה שקצב ימכור לו תנאו קיים (הגהות מרדכי פ' איזהו נשך והמגיד פ"ח דמכירה):

The law of "When I sell, I will sell to you for a hundred", and he sold to another for more; or where he said: I will sell it to you as the court will appraise it; it contains four se'ifim. One who says to his fellow: when I sell this field, it is sold to you from now for a maneh, and they made a kinyan (a formal act of acquisition) from him on this, and after a time he sold it to another for a hundred — the first has acquired (if he did not mention a sum, but said to him: when I sell it, I will sell to you, the first has not acquired) (Tur). And likewise, if he sold it for more than a maneh, the latter has acquired; for he said to him only "when I sell", meaning that he would be selling of his own mind, as at first; and this one did not wish to sell, and sold only because of the addition that the other added, so that he is found to be as one who was under duress and sold. Hagah [Rema]: And all this speaks where he said in the words "when I sell, I will sell to you", and so on; but if he said: you shall sell only to me (Maharik, shoresh 20), or he stipulated expressly that even if they give him more than what he fixed, he will sell to him — his condition stands (Hagahot Mordechai, chapter "Which is interest", and the Maggid, chapter 8 of the Laws of Sale).

Se’if 2ב׳

א"ל כשאמכרנה הרי היא קנויה לך מעכשיו כמו שישומו ב"ד של ג' אפי' ע"פ שנים מהשלש' א"ל כמו שיאמרו שלשה עד שיאמרו הג':

If he said to him: when I sell it, it is acquired by you from now as a court of three will appraise it — even by the word of two of the three. If he said to him: as three will say — not until all three say it.

Se’if 3ג׳

וכן אם אמר כמו שישומו אותה ב"ד ארבעה עד שישומו הארבעה כולם ויסכימו וימכור לאחר כמו שיסכימו ואח"כ קנה הראשון:

And likewise, if he said: as a court of four will appraise it — not until all four appraise it and agree; and he sells to another as they agree, and afterwards the first has acquired.
