דין מוכר מחמת אונס ומסר מודע' ובטלה. ובו יב סעיפים: מי שאנסוהו עד שמכר ולקח דמי המקח אפי' תלוהו עד שמכרו ממכרו ממכר בין במטלטלים בין בקרקע שמפני אונסו גמר והקנה אע"פ שלא לקח הדמים בפני העדים: הגה ויש חולקין וסבירא להו דבעינן שראו העדים נתינת המעות אבל הודאתו לחוד לא מהני (טור וראב"ד פ"י דמכירה) וי"א דבעינן דוקא שנתן לו המעות אבל אם נתן לו שטר עליו אינו קונה (ב"י בשם הראב"ד לדעת הרי"ף) ויש חולקין (ב"י לדעת הרי"ף והרא"ש) לפיכך אם מסר מודעא קודם שימכור ואמר לשני עדים דעו שזה שאני מוכר חפץ פלוני או שדה פלוני לפלוני מפני אונס הרי המכר בטל ואפי' החזיק כמה שני' מוציאים אותה מידו ומחזיר הדמים וצריכים העדים לידע שהוא מוכר מפני האונס ושהוא אנוס ודאי לא שיסמכו על פיו וכל מודעא שאין כתו' בה אנו העדי' ידענו שפלוני זה אנוס היה אינ' מודעא:

The law of one who sells under duress and delivered a declaration of protest (made before witnesses, that what he does he does under duress), and it was cancelled; it contains twelve se'ifim. One whom they coerced until he sold, and he took the price of the merchandise — even if they hanged him until he sold, his sale is a sale, whether with movables or with land; for on account of his duress he made up his mind and conveyed, even though he did not take the price before witnesses. Hagah [Rema]: And there are those who disagree and hold that we require that the witnesses saw the giving of the money, but his admission alone does not avail (Tur, and the Raavad, chapter 10 of the Laws of Sale); and some say that we require specifically that he gave him the money, but if he gave him a document for it, he does not acquire (Beit Yosef in the name of the Raavad, according to the view of the Rif); and there are those who disagree (Beit Yosef, according to the view of the Rif and the Rosh). Therefore, if he delivered a declaration of protest before he sold, and said to two witnesses: know that this, that I am selling such-and-such an article or such-and-such a field to so-and-so, is because of duress — the sale is void; and even if the buyer held it several years, they take it out of his hand, and he returns the price. And the witnesses must know that he sells because of duress, and that he is certainly under duress, not relying on his word; and any declaration of protest in which is not written: we the witnesses knew that this so-and-so was under duress — is no declaration of protest.

Se’if 2ב׳

בד"א במכר אבל במתנה או מחילה אין צריכין להכיר אונסו:

When is this said? With a sale; but with a gift or a waiver, they need not recognise his duress.

Se’if 3ג׳

פשרה דינה כמכר ומחילה דינה כמתנה מתנה שכתוב בה אחריות נכסים דינה כמכר (ריב"ש סי' ר"ן):

A compromise — its law is as a sale; and a waiver — its law is as a gift. A gift in which a liability on property is written — its law is as a sale (Rivash, siman 250).
