Choshen Mishpat 204
Siman 204 of 427 in Choshen Mishpat — 11 se'ifim
Se’if 1א׳
When one who retracts receives mi shepara (the curse pronounced upon one who retracts from a sale), and when one is called wanting in faithfulness; it contains eleven se'ifim. One who gave the price and did not draw the movables — even though the movables were not acquired by him, as was explained, whoever retracts, whether buyer or seller, has not acted as an Israelite should, and must accept mi shepara; and even if he gave only part of the price.
Se’if 2ב׳
If he gave the price of the merchandise and it was lost by mishap before he took it, and he said to him: give me my merchandise or return me my money — even though there are witnesses that it was lost by mishap, and the seller had no power to rescue it, and was not negligent in the matter, he returns the price, and there is no place here for mi shepara. And some say that the same law applies to one who retracts because he fears he will lose the whole merchandise.
Se’if 3ג׳
One who fixes a price at the market rate and received money, and did not have that kind for which he fixed the price — it has been explained in siman 209 (see below, siman 209, se'if 6).
