כל מטלטלין נקנין בחליפין ומטבע אין נקנה בחליפין. ובו י סעיפים: כל המטלטלין קונים זה את זה בחליפין א"צ לומר אם אין המקנה מקפיד לידע שיווי החפץ שנוטל בחליפין כעין שקונין בסודר שזהו קנין גמור שמועיל לכל הדברים בין קרקע בין מטלטלי (חוץ משטרות וע' לעיל סי' ס"ו) בין בעלי חיים ופירות נמי אע"פ שאין קונים בהם נקנים בחליפין חוץ ממטבע שאינו נקנה בחליפין ולא קונה וכן דבר שאין בו ממש אין קנין מועיל בו כגון שקנו ממנו שילך עם פלוני למקום פלוני או שיחלקו חצר שביניהם (ועיין לעיל סי' קנ"ז סעיף ב') וכיוצא באלו שהם קנין דברים ואין לו על מה לחול: הגה וטובת הנאה לאו ממון ואינה נקנה בחליפין (הגהות מיימוני פ"ה דמכירה) ועיין לקמן סי' רמ"ה האומר אתן דבר לפלוני אי הוי קנין דברים מי שקנו ממנו שיעשה שטר מחילה לחבירו הוי קנין דברים דשטר מחילה אינו אלא סילוק בעלמא אבל אי קנו ממנו להחזיר לחבירו כל זכיותיו שיש לו עליו לא הוי קנין דברים (תשובת רשב"א אלף ל"ג) אלא אפי' מקפיד לידע שיווי החפץ שנוטל דהשתא דומה לדמים אפ"ה נקנה כיצד היה לזה פרה ולזה חמור והעריכו אותם כמה שוה כל א' מהם והסכימו להחליפם זה בזה כיון שמשך בעל הפרה את החמור נקנית פרתו לבעל החמור בכל מקום שהיא ואין שום אחד מהם יכול לחזור בו (וי"א דאם העריכו זה כנגד זה קונין אף בפירות ויש חולקין עיין בב"י שתי הדעות):
All movables are acquired by chalifin (acquisition by the exchange of an article), and a coin is not acquired by chalifin; it contains ten se'ifim. All movables acquire one another by chalifin. Needless to say, where the one conveying does not care to know the value of the article he takes in exchange, as when they acquire by a cloth — for that is a complete kinyan (a formal act of acquisition), which avails for all things, whether land or movables (except documents; and see above, siman 66), or animals; produce too, even though one does not acquire with it, is acquired by chalifin — except a coin, which is neither acquired by chalifin nor acquires. And likewise a thing that has no substance — a kinyan does not avail for it; for example, they made a kinyan from him that he would go with so-and-so to such-and-such a place, or that they would divide a courtyard between them (and see above, siman 157, se'if 2), and the like, which are a kinyan of words and have nothing on which to take effect. Hagah [Rema]: And tovat hana'ah (an advantage that is not itself money) is not money, and it is not acquired by chalifin (Hagahot Maimoni, chapter 5 of the Laws of Sale); and see below, siman 245, on one who says: I will give something to so-and-so, whether it is a kinyan of words. One from whom they made a kinyan that he would make a document of waiver to his fellow — it is a kinyan of words, for a document of waiver is only a mere withdrawal; but if they made a kinyan from him to return to his fellow all the rights that he has against him, it is not a kinyan of words (a responsum of the Rashba, 1033). But even where he cares to know the value of the article he takes, so that it is now like a price, nevertheless it is acquired. How? This one had a cow and that one a donkey, and they valued how much each of them is worth and agreed to exchange them one for the other — once the owner of the cow has drawn the donkey, his cow is acquired by the owner of the donkey wherever it is, and neither of them can retract (and some say that if they valued one against the other, one acquires even with produce; and there are those who disagree; see Beit Yosef, the two opinions).

החליף חמור בפרה וטלה ומשך את הפרה ולא משך את הטלה לא קנה מפני שאין כאן משיכ' גמורה וי"א דדוקא בכהאי גוונא משום שאין החמור ראוי ליחלק אבל אם אמר פרה וטלה בכור חטים ומשך הפר' ולא משך הטל' קנה בחטי' כנגד דמי הפר' (וי"א דאם ראובן החליף עם שמעון ולוי ונתבטל אצל אחד בטל ג"כ נגד השני) (ת"ה סי' שי"א):
If he exchanged a donkey for a cow and a lamb, and drew the cow but did not draw the lamb, he has not acquired, because there is no complete drawing here. And some say that this is specifically in such a case, because the donkey is not fit to be divided; but if he said: a cow and a lamb for a kor of wheat, and he drew the cow and did not draw the lamb, he has acquired of the wheat as much as the price of the cow (and some say that if Reuven made an exchange with Shimon and Levi, and it was cancelled as to one of them, it is cancelled as to the second too) (Terumat haDeshen, siman 311).

לשונות של זהב ושל כסף ושל שאר מיני מתכו' הרי הם כשאר מטלטלים ונקנים בקנין וקונין זה את זה בהחלפה אבל המטבעות של כסף או של זהב או של נחושת הרי כולם דמים כנגד שאר מטלטלים והנותן אחד מהם בדמי מטלטלים לא קנה ואין אחד מהם נקנה בקנין ולא נעשה קנין: הגה ולפיכך המייחד מעות והקנה לאחד בחליפי המטלטלים הואיל ולא קנה זה המעות לא קנה זה המטלטלין אע"פ שמשכן ודוקא בתורת חליפין שייחד לו המעות אבל בתורת דמים משמשך החפץ נתחייב בדמיו מיד (טור):
Bars of gold, of silver, and of other kinds of metal are as other movables: they are acquired by a kinyan, and acquire one another by exchange. But coins of silver, or of gold, or of copper are all price in relation to other movables, and one who gives one of them as the price of movables has not acquired; and none of them is acquired by a kinyan, nor serves as a kinyan. Hagah [Rema]: And therefore one who sets aside money and conveyed it to someone in exchange for movables — since this one did not acquire the money, that one did not acquire the movables, even though he drew them. And this is specifically by way of chalifin, where he set aside the money for him; but by way of price, once he has drawn the article he is liable for its price at once (Tur).
