דין קניית מטלטלין אגב קרקע או עבדים וקרקע או עבד ומטלטלין או בהמה וכלים שעליה. ובו טו סעיפים: המקנה קרקע ומטלטלין כאח' כיון שקנה הקרקע באחד מדרכי הקנייה נקנו המטלטלין עמהם בין שהיו שניהם במכר או במתנה בין שמכר מטלטלין ונתן קרקע בין שמכר קרקע ונתן מטלטלים כיון שקנה קרקע קנה המטלטלים וי"א דאפי' הקרקע בשכירות ומטלטלין במתנה (ר"י נ"י ח"ב) :
The law of the acquisition of movables by agav (acquired along with land) of land, or of slaves and land, or a slave and movables, or an animal and the vessels on it; it contains fifteen se'ifim. One who conveys land and movables together — once the other has acquired the land by one of the ways of acquisition, the movables are acquired with it; whether both were by sale or by gift, or he sold movables and gave land, or sold land and gave movables — once he has acquired the land, he has acquired the movables. And some say that this holds even if the land is by hire and the movables by gift (Rabbeinu Yerucham, netiv 10, part 2).
Se’if 2ב׳
בד"א כשהיו אותם המטלטלים צבורים באות' קרקע אבל אם היו במקום אחר צריך שיאמר לו קנה מטלטלין אגב קרקע אפי' היו המטלטלין במדינה אחרת וא"ל קנה אותם ע"ג קרקע פלוני כיון שקנה קרקע נקנו המטלטלין אע"פ שאינם צבורים בתוכה ואם לא אמר ליה קנה אגב קרקע לא קנה מאחר שאינם צבורים בתוכה: הגה וי"א דאפי' הם צבורים בתוכה צריך שיאמר קנה אגב קרקע (טור בשם הראב"ד והרא"ש) וכן נראה לי עיקר וי"א דבעינן דוקא לשון אגב אבל עם לא מהני (ר"ן פ"ק דקדושין בשם רש"י) ויש חולקין (שם בשם הרא"ה):
When is this said? When those movables were heaped on that land; but if they were in another place, he must say to him: acquire the movables by agav of land. Even if the movables were in another province, and he said to him: acquire them upon such-and-such land, once he has acquired the land the movables are acquired, even though they are not heaped on it; and if he did not say to him: acquire by agav of land, he has not acquired, since they are not heaped on it. Hagah [Rema]: And some say that even if they are heaped on it he must say: acquire by agav of land (Tur in the name of the Raavad and the Rosh); and so it seems to me the principal view. And some say that we require specifically the word agav, but "with" does not avail (the Ran, chapter 1 of Kiddushin, in the name of Rashi); and there are those who disagree (there, in the name of the Ra'ah).
Se’if 3ג׳
הקנה השדה לאחד והמטלטלים לאחר אע"פ שא"ל קנה המטלטלים על גבי קרקע והחזיק האחד בקרקע לא קנה השני מטלטלין ואם תפסן אחר שחזר בו המקנה אין מוציאין מידו שהרי תפסן אחר שקנה חבירו הקרקע שנקנו אלו על גבו (ויש חולקין וסבירא להו דמוציאין מיד התופס כדין כל ספק ממון) (ר"ן פ"ק דקדושין):
If he conveyed the field to one and the movables to another, even though he said to him: acquire the movables upon the land, and the one took possession of the land, the second has not acquired the movables. And if he seized them after the one conveying retracted, they do not take them out of his hand, since he seized them after his fellow had acquired the land upon which these were conveyed (and there are those who disagree and hold that they take them out of the seizer's hand, as with every case of doubtful money) (the Ran, chapter 1 of Kiddushin).
