דין רושם על החבית והתוקע כפו לחבירו. ובו ב סעיפים: מכר לו בדברים בלבד ופסקו הדמים ורשם הלוקח רושם על המקח כדי שיהיה לו סימן ידוע שהוא שלו אע"פ שלא נתן לו מהדמים כלום כל החוזר בו אחר שרשם מקבל מי שפרע ואם מנהג המדינה הוא שיקנה הרושם קנין גמור נקנה המקח ואין אחד מהם יכול לחזור בו וחייב זה ליתן הדמים והוא שרשם בפני המוכר או שאמר ליה המוכר רשום מקחך:
The law of one who makes a mark on a barrel, and of one who gives his fellow a handclasp; it contains two se'ifim. If he sold to him by words alone, and they fixed the price, and the buyer made a mark on the merchandise so that he would have a known sign that it is his, even though he gave him nothing of the price — whoever retracts after he has marked it receives mi shepara (the curse pronounced upon one who retracts from a sale). And if it is the custom of the country that the mark acquires as a complete kinyan (a formal act of acquisition), the merchandise is acquired, and neither of them can retract, and this one must give the price; provided that he marked it in the seller's presence, or the seller said to him: mark your merchandise.

וכן כל דבר שנהגו התגרים לקנות בו כגון ע"י שנותן הלוקח פרוטה למוכר או על ידי שתוקע לו כפו (או במקום שנוהגים הסוחרים שמוסרים לקונה המפתח) (הגהות מיימוני פ"ז דמכירה) וכן כל כיוצא בזה:
And the same applies to anything by which the traders are accustomed to acquire — for example, by the buyer's giving the seller a perutah, or by his giving him a handclasp (or in a place where the merchants are accustomed to hand the key to the buyer) (Hagahot Maimoni, chapter 7 of the Laws of Sale) — and likewise in every case like this.
