דין קניית מטלטלין על ידי חצירו וכיצד קונה כליו. ובו יב סעיפים: היו מטלטלין ברשות הלוקח המשתמר לדעתו: הגה ויש חולקין וסבירא להו דבמכר או מתנה אם משומר לדעת המוכר או הנותן סגי וקנה (ע' בב"י) וכן נראה להורות מיהו אם המוכר השכיר לו חצר עצמו והמטלטלין שמוכר לו מעורבין עדיין עם שאר מטלטלין של מוכר מקרי חצר שאינו משומר ולא קנה (הגהות מרדכי פ"ק דמציעא) או שהוא עומד בצד אותו רשות (וי"א דבעינן דוקא בתוכו אבל חוצה לו לא) (המגיד פ"ו דגזילה) כיון שקבל עליו המוכר למכור קנה לוקח ואע"פ שעדיין לא מדד והוא שפסק דמים (וי"א דארבע אמות של אדם קונין לו כמו במציאה) (עיין בב"י):

The law of the acquisition of movables by means of his courtyard, and how his vessels acquire; it contains twelve se'ifim. If the movables were in the buyer's domain, which is guarded with his knowledge — Hagah [Rema]: And there are those who disagree and hold that with a sale or a gift, if it is guarded with the knowledge of the seller or the giver, that suffices and he has acquired (see Beit Yosef); and so it seems right to rule. However, if the seller let him his own courtyard, and the movables he sells him are still mixed with the seller's other movables, it is called a courtyard that is not guarded, and he has not acquired (Hagahot Mordechai, chapter 1 of Bava Metzia) — or he stands beside that domain (and some say that we require specifically that he be inside it, but outside it, no) (the Maggid, chapter 6 of the Laws of Robbery): once the seller has undertaken to sell, the buyer has acquired, even though he has not yet measured; provided that he fixed the price (and some say that a person's four cubits acquire for him, as with a found object) (see Beit Yosef).

היו ברשות המוכר או ברשות אדם אחר שהם מופקדים אצלו לא קנה הלוקח עד שיגביה המטלטלין או עד שימשכם כמו שנתבאר: הגה מיהו אם שכר המקום שמונח בו או נתנו לו במתנה ובקנין או אפי' בדבור בעלמא קנאו דהשתא הוי ברשותו וקונה לו והא דמהני דבור בעלמא היינו ברשות אחר אבל אם מונח ברשות המוכר ואומר יזכה חצרי ללוקח במקח שקנה ממני לא קנה עד שישכיר לו מקומו ויקנה לו בא' מדרכי הקנייה (טור בשם הרא"ש ור' ירוחם נ"י ח"ב) ואם היו הפירות מופקדים ביד אחר לא סגי שיאמר תקנה חצרי ללוקח עד שיאמר כן מדעת המוכר (ב"י בשם הרמב"ן והמגיד פ"ד דמכירה):

If they were in the seller's domain, or in the domain of another person with whom they are deposited, the buyer has not acquired until he lifts the movables or until he draws them, as was explained. Hagah [Rema]: However, if he hired the place in which it lies, or they gave it to him as a gift, with a kinyan (a formal act of acquisition) or even by mere speech, he has acquired it, for now it is in his domain and acquires for him. And where mere speech avails, that is in another's domain; but if it lies in the seller's domain and he says: let my courtyard acquire for the buyer the merchandise he bought from me, he has not acquired until he hires him his place and conveys it to him by one of the ways of acquisition (Tur in the name of the Rosh, and Rabbeinu Yerucham, netiv 10, part 2). And if the produce was deposited in another's hand, it is not enough that he say: let my courtyard acquire for the buyer, unless he says so with the seller's consent (Beit Yosef in the name of the Ramban, and the Maggid, chapter 4 of the Laws of Sale).

כליו של אדם כל מקום שיש לו רשות להניחו קנה לו וכיון שנכנסו המטלטלים בתוך הכלי אין א' מהם יכול לחזור בו והרי זה כמי שהונחו בתוך ביתו: הגה ויש מחלקין דאם אינן ברשות לוקח רק בסימטא וכיוצא בזה אין כליו קונים אא"כ מדד או עד שיאמר לו זיל וקני (טור ותוס' והרא"ש פרק הספינה והגהות מיימוני פ"ד דמכירה) לפיכך אין כליו של אדם קונים לו ברשות הרבים ולא ברשות המוכר אלא א"כ אמר לו המקנה לך וקנה בכלי זה ואז קנה אם הוא ברשות המוכר:

A person's vessels, in any place where he has permission to set them down, acquire for him; and once the movables have entered into the vessel, neither of them can retract, and it is as if they had been placed within his house. Hagah [Rema]: And some distinguish: if they are not in the buyer's domain but only in a side-street and the like, his vessels do not acquire unless he measured, or until he says to him: go and acquire (Tur, and the Tosafot and the Rosh, chapter "The ship", and Hagahot Maimoni, chapter 4 of the Laws of Sale). Therefore a person's vessels do not acquire for him in the public domain, nor in the seller's domain, unless the one conveying said to him: go and acquire by this vessel; and then he has acquired, if it is in the seller's domain.
