Se’if 1א׳
יש דרכים שמעות קונות ויש זמן שמעות קונות. ובו ד סעיפים: יש מעות קונות כיצד היו לו מעות בידו בלא מנין ובלא משקל ואמר לחבירו מכור לי חפץ שלך במעות אלו שבידי ולקחם המוכר ולא דקדק לידע מנינם נקנה החפץ ללוקח ואין אחד מהם יכול לחזור בו מפני שהוא דבר שאינו מצוי לא גזרו ביה רבנן: הגה ואפי' הלוקח ידע מנינם רק שאמר למוכר מכור לי באלו והמוכר לא דקדק במנינם יש אומרים דקנה (עיין בב"י):
There are ways in which money acquires, and there is a time when money acquires; it contains four se'ifim. There are cases where money acquires — how? He had money in his hand, uncounted and unweighed, and said to his fellow: sell me your article for this money that is in my hand; and the seller took it and did not take care to know its count — the article is acquired by the buyer, and neither of them can retract; since it is a thing that is not common, the Rabbis did not decree concerning it. Hagah [Rema]: And even if the buyer knew its count, but said to the seller: sell to me for these, and the seller did not take care about its count, some say that he has acquired (see Beit Yosef).

וכן ראובן שמכר מטלטלין לשמעון במנה וקנה שמעון המטלטלין ונתחייב לראובן בדמים ואח"כ היה לשמעון מטלטלים אחרים למכור וא"ל ראובן מכור אות' בדמים שיש לי בידך מדמי המכר ואמר ליה הן נקנין אותן המטלטלים לראובן בכל מקום שהם ואע"פ שלא משך ולא הגביה שגם זה דבר שאינו מצוי הוא ולא גזרו ביה רבנן אבל אם היה עליו חוב שלא מחמת המכר וא"ל מכור לי מטלטלין בחוב שיש לי אצלך ונתרצו שניהם לא קנה: הגה מיהו י"א דמיירי דוקא שאמר ליה מכור לי בהנאת מחילת הדמים שיש לי אצלך אבל אם אמר ליה מכור לי בדמים שיש לי בידך לא קנה (המגיד פ"ז דמכירה ור"ן פ' הזהב וע' בב"י) וע' לקמן סי' ר"ד סעיף י':
And likewise Reuven, who sold movables to Shimon for a maneh, and Shimon acquired the movables and became liable to Reuven for the price; and afterwards Shimon had other movables to sell, and Reuven said to him: sell them to me for the price that I have in your hand from the price of the sale, and he said to him: yes — those movables are acquired by Reuven wherever they are, even though he did not draw or lift; for this too is a thing that is not common, and the Rabbis did not decree concerning it. But if he owed him a debt that was not on account of the sale, and he said to him: sell me movables for the debt that I have with you, and both of them agreed, he has not acquired. Hagah [Rema]: However, some say that this speaks specifically where he said to him: sell to me for the benefit of the waiver of the price that I have with you; but if he said to him: sell to me for the price that I have in your hand, he has not acquired (the Maggid, chapter 7 of the Laws of Sale, and the Ran, chapter "The gold", and see Beit Yosef); and see below, siman 204, se'if 10.

יש זמן שמעות קונות שהעמידו חכמים דבריהן על דין תורה בבשר בארבעה פרקים ואלו הם ערב יום טוב האחרון של חג וערב יום טוב ראשון של פסח וערב העצרת וערב ראש השנה שאם היה לטבח שור שוה מאה דינרים ולקח מהלוקח דינר כדי ליתן לו בשר כשישחוט ולא נתקבצו לו כל דמי השור משחיטין אותו בעל כרחו כדי ליתן הבשר ללוקח לפיכך אם מת השור מת ללוקח ומפסיד הדינר: הגה ויש מי שכתב דה"ה הנותן מעות על יין לקידוש בערב שבת דקנה דכל כהאי גוונא העמידו דבריהם על דין תורה (מהרי"ל):
There is a time when money acquires, for the Sages established their words upon the law of the Torah for meat at four seasons, and these are they: the eve of the last festival day of the Festival, and the eve of the first festival day of Passover, and the eve of Atzeret, and the eve of Rosh Hashanah; so that if a butcher had an ox worth a hundred dinars, and took a dinar from a buyer in order to give him meat when he slaughters, and the whole price of the ox had not been gathered for him, they make him slaughter it against his will in order to give the meat to the buyer. Therefore, if the ox died, it died for the buyer, and he loses the dinar. Hagah [Rema]: And there is one who has written that the same law applies to one who gives money for wine for Kiddush on the eve of the Sabbath, that he has acquired; for in every case like this they established their words upon the law of the Torah (Maharil).
