דין קניית בהמה גסה ודקה. ובו ז סעיפים: בהמה בין דקה בין גסה אינה נקנית במסירה אלא במשיכ' ואינו צריך להגביה: הגה וי"א דאף מסירה קונה בבהמה גסה (הגהות מיימוני פ"ב דמכירה בשם ראבי"ה) וי"א אף בדקה (טור תוס' ואשירי ר"פ הספינה ופ"ק דקידושין בשם רש"י ור"ת) אם הוא בפני המוכר (רש"י וריב"א) וע"ל סי' קצ"ח ס"ח עד י"ג בדיני מסירה א"ל לקנות במשיכה ושינה בין לגריעותא כגון למסירה או למעליותא כגון שהגביה לא קנה אלא במשיכה כמו שא"ל (טור בשם ר"י והרי"ף והרא"ש):
The law of the acquisition of large and small cattle; it contains seven se'ifim. An animal, whether small or large, is not acquired by handing over but by drawing, and he need not lift it. Hagah [Rema]: And some say that handing over also acquires with large cattle (Hagahot Maimoni, chapter 2 of the Laws of Sale, in the name of Raavyah); and some say even with small (Tur; the Tosafot and Asheri, beginning of chapter "The ship" and chapter 1 of Kiddushin, in the name of Rashi and Rabbeinu Tam), if it is in the seller's presence (Rashi and the Riva). And see below, siman 198, se'ifim 8 to 13, on the laws of handing over. If he told him to acquire by drawing, and he departed from it, whether for the worse — for example, to handing over — or for the better — for example, he lifted it — he has acquired only by drawing, as he told him (Tur in the name of the Ri, the Rif and the Rosh).
Se’if 2ב׳
הגבהה קונה בכל מקום אבל משיכה אינו קונה אלא בסימטא או בחצר של שניהם אבל לא ברשות הרבים ולא בחצר שאינה של שניהם:
Lifting acquires in every place; but drawing acquires only in a side-street or in a courtyard belonging to both of them, and not in the public domain, nor in a courtyard that does not belong to both of them.
Se’if 3ג׳
כיצד קונין את הבהמה במשיכה א"צ לומר אם משכה והלכה או שרכב עליה והלכה בו שקנה אלא אפילו קרא לה ובאה או שהכישה במקלו (או שהנהיגה בקול) (טור) ורצתה בפניו כיון שעקרה יד ורגל קנאה והוא שימשוך בפני הבעלים ואם משך שלא בפני הבעלים צריך שיאמר לו קודם שימשוך לך משוך וקני (וע"ל סימן רע"א מדינין אלו):
How does one acquire an animal by drawing? Needless to say, if he drew it and it went, or he rode on it and it went with him, he has acquired; but even if he called it and it came, or struck it with his stick (or drove it with his voice) (Tur) and it ran before him — once it has lifted a forefoot and a hind foot, he has acquired it. Provided that he draws in the owner's presence; and if he drew not in the owner's presence, the owner must say to him before he draws: go, draw and acquire (and see below, siman 271, on these laws).
