Se’if 1א׳
דין קניית קרקע או מטלטלין בחליפין. ובו יא סעיפים: בקנין כיצד יתן הקונה למקנה כלי כל שהוא ויאמר לו קנה זה חלף הקרקע או המטלטל שמכרת או שנתת לי (ואין נוהגין שיאמר לו הקונה כן כי מסתמא אדעתא דהכי הוא נותן לו) (טור) וכיון שמשך המקנה הכלי נקנה הקרקע או המטלטלים ללוקח או למקבל מתנה בכל מקום שהוא אע"פ שלא החזיק ולא נתן כסף ולא כתב שטר ולא משך ואין שום אחד מהם יכול לחזור בו אפי' אין עדים בדבר אם מודים זה לזה: הגה וכן אם קבלו קנין לפני פסולי עדות הוי קנין הואיל ומודים זה לזה שקנה (הרא"ש כלל ס"ו סי' ח'):
The law of the acquisition of land or movables by chalifin (acquisition by the exchange of an article); it contains eleven se'ifim. By a kinyan (a formal act of acquisition) — how? The one acquiring gives the one conveying any vessel whatever, and says to him: acquire this in exchange for the land or the movable that you sold or gave me (and it is not the custom for the one acquiring to say this to him, for presumably it is with this in mind that he gives it to him) (Tur). And once the one conveying has drawn the vessel, the land or the movables are acquired by the buyer or by the recipient of the gift wherever they are, even though he did not take possession, did not give money, did not write a document, and did not draw; and neither of them can retract, even if there are no witnesses to the matter, if they admit it to one another. Hagah [Rema]: And likewise, if they made the kinyan before persons disqualified from testimony, it is a kinyan, since they admit to one another that he acquired (the Rosh, klal 66, siman 8).
Se’if 2ב׳
אין קונים אלא בכלי ואע"פ שאין בו שוה פרוטה (ובלבד שיהא עשוי מדבר חשוב לאפוקי כלי העשוי מגללי בקר) (טור) ואין קונים בדבר שאסור בהנאה ולא בפירות ולא במטבע (בהמה מקרי כלי וקונין בה אבל שאר מטלטלין שאינן כלי אין קונין בהם (טור) מטבע שנפסל לגמרי הוי ככלי וקונין בהם) (טור סי' ר"ג) ואין קונין בכליו של מקנה:
One acquires only with a vessel, even though it is not worth a perutah (provided that it is made of something of consequence, which excludes a vessel made of cattle dung) (Tur); and one does not acquire with a thing forbidden for benefit, nor with produce, nor with a coin (an animal is called a vessel, and one acquires with it; but other movables that are not vessels, one does not acquire with them) (Tur) (a coin that has been wholly invalidated is as a vessel, and one acquires with it) (Tur, siman 203); and one does not acquire with the vessel of the one conveying.

הקנה אחד כלי למוכר כדי שיקנה הלוקח אותו הממכר זכה הלוקח אפי' הקנהו שלא בפני הקונה ואע"פ שהקנה לו הכלי ע"מ להחזירו נקנה המקח: הגה ולכך הורגלו לעשות הקנין בסודר של עדים אפי' בפני הקונה לפי שרוב הקנינים הן שלא בפני הקונה (טור בשם הרא"ש) והא דנקנה המקח שלא בפני הקונה היינו במתנה וכיוצא בזה דודאי ניחא ליה אבל במקח שאפשר שאינו חפץ לקנות לא קנה ושניהן חוזרין (מהרי"ו ס' ד'):
If one conveyed a vessel to the seller so that the buyer should acquire that merchandise, the buyer has acquired, even if he conveyed it to him not in the buyer's presence; and even though he conveyed the vessel to him on condition that he return it, the sale is acquired. Hagah [Rema]: And therefore they became accustomed to make the kinyan with the witnesses' cloth even in the buyer's presence, since most kinyanim are not in the buyer's presence (Tur in the name of the Rosh). And what we say, that the sale is acquired not in the buyer's presence, is with a gift and the like, where it certainly pleases him; but with a sale, where it may be that he does not wish to buy, he has not acquired, and both of them can retract (Maharyu, siman 4).
