עכו"ם שמכר קרקע לישראל וקיבל כסף ולא כתב שטר. ובו ג סעיפים: העכו"ם אינו קונה בחזקה (ולא בכסף) אלא בשטר הוא שקונה עם נתינת הכסף וישראל הקונה מעכו"ם הרי הוא כעכו"ם ואינו קונה אלא בשטר : הגה מיהו שכירות מן העכו"ם קונה בכסף לחוד (ב"י סימן קצ"ב) וכן אם התנה לוקח שיקנה לו בכסף בלחוד קנה מיד (ב"י בסי' זה):

A gentile who sold land to an Israelite and received money but did not write a document; it contains three se'ifim. A gentile does not acquire by taking possession (nor by money); it is by a document, together with the giving of the money, that he acquires. And an Israelite who buys from a gentile is as a gentile, and acquires only by a document. Hagah [Rema]: However, hire from a gentile is acquired by money alone (Beit Yosef, siman 192); and likewise, if the buyer stipulated that it should be acquired by him by money alone, he has acquired at once (Beit Yosef in this siman).

מאחר שעכו"ם אינו קונה הקרקע מישראל ולא מקנהו לישראל אלא בשטר ישראל שלקח שדה מהעכו"ם ונתן דמים וקודם שיחזיק בה בא ישראל אחר והחזיק בה כדרך שמחזיקים בנכסי הגר זכה אחרון וי"א דאפי' החזיק בה ראשון זכה האחרון דלא סמכא דעתא דראשון בלא שטר (טור בשם רשב"א והמגיד פ"א דזכיה ונ"י וכן משמע במרדכי פ' חזקת) וכן נ"ל אבל אם החזיק הא' קודם שנתן המעות זכה (לכולי עלמא) (מרדכי פ' חזקת) ונותן לראשון את הדמים מפני שהעכו"ם מעת שלקח הדמים סילק רשותו וישראל לא קנה עד שיגיע השטר לידו ונמצאו נכסים אלו כנכסי מדבר שכל המחזיק בהם זכה ואחריותו על העכו"ם המוכר: הגה והשני מקרי רשע (טור בשם הרשב"ם ועיין בב"י) ומ"מ אם בא הראשון להשתדל ע"י העכו"ם להוציאו מיד השני נקרא מסור הואיל והשני נותן לו מעותיו (טור בשם הרא"ש והגהות אשירי ותוספות ומרדכי) בד"א במקום שאין משפט ידוע למלך אבל אם דין אותו המלך ומשפטו שלא יזכה בקרקע אלא מי שכתוב בשטר או הנותן דמים וכיוצא בדברים אלו עושים כפי משפט המלך: הגה עכו"ם שהיה לו משכון או פקדון ביד ראובן ונתנו לשמעון בשטר זכה ראובן במה שבידו דמיד שנתן העכו"ם לשמעון נסתלק העכו"ם ושמעון לא קנה עד דמשיך ולכן הוי כהפקר וזכה בו ראובן כזוכה מן ההפקר (תשובת רשב"א סי' אלף ל"ב ור' ירוחם נכ"ג):

Since a gentile neither acquires land from an Israelite nor conveys it to an Israelite except by a document — an Israelite who bought a field from a gentile and gave the price, and before he took possession of it another Israelite came and took possession of it in the way one takes possession of a convert's property: the latter has acquired. And some say that even if the first took possession of it, the latter has acquired, for the first does not rely on it without a document (Tur in the name of the Rashba; the Maggid, chapter 1 of the Laws of Acquisition; Nimukei Yosef; and so it is implied in Mordechai, chapter "The presumption of houses"); and so it seems to me. But if the first took possession before he gave the money, he has acquired (according to all) (Mordechai, chapter "The presumption of houses"). And the latter gives the first the price; for the gentile, from the moment he took the price, removed his domain, and the Israelite has not acquired until the document reaches his hand, so that this property is found to be as property in the wilderness, which whoever takes possession of acquires; and the liability for it is upon the gentile seller. Hagah [Rema]: And the second is called wicked (Tur in the name of the Rashbam, and see Beit Yosef). And nevertheless, if the first comes to exert himself through the gentile to take it out of the second's hand, he is called an informer, since the second gives him his money (Tur in the name of the Rosh, and Hagahot Asheri, and the Tosafot, and Mordechai). When is this said? In a place where the king has no known law; but if the law of that king and his statute is that none acquires land except the one written in the document, or the one who gives the price, and matters like these, they act according to the king's statute. Hagah [Rema]: A gentile who had a pledge or a deposit in Reuven's hand and gave it to Shimon by a document — Reuven has acquired what is in his hand; for as soon as the gentile gave it to Shimon, the gentile removed himself, and Shimon did not acquire until he drew it; and therefore it is as ownerless property, and Reuven acquires it as one who acquires from ownerless property (a responsum of the Rashba, siman 1032, and Rabbeinu Yerucham, netiv 23).

יש מי שאומר שאפי' אם כתב העכו"ם שטר לראשון קודם שיחזיק בו אחר אינו כלום כיון שכבר נסתלק הרי הוא כאחר אלא צריך שיכתוב השטר קודם שיקבל המעות (וכל זה לא מיירי אלא בקרקע אבל במטלטלין קנה בנתינת המעות) (טור):

There is one who says that even if the gentile wrote a document for the first before another took possession of it, it is nothing: since he has already removed himself, he is as a stranger; rather he must write the document before he receives the money (and all this speaks only of land; but with movables he acquires by the giving of the money) (Tur).
