המחובר לקרקע דינו כקרקע. ובו סעיף אחד: כל המחובר לקרקע שצריך לקרקע הרי הוא כקרקע ונקנה בכסף או בשטר או בחזקה אפילו לא נתכוין לקנות הקרקע אלא החזיק בקרקע לקנות המחובר בו או נתן כסף בעד הקרקע כדי לקנות המחובר בו קנה אע"פ שלא קנה הקרקע אבל אם אינו צריך לקרקע כגון ענבים העומדים ליבצר ה"ז כמטלטלין לקנין ויש להם אונאה (ויש חולקין ואומרים דאפי' אין צריך לקרקע דינן כקרקע) (טור):
What is joined to the ground: its law is as the ground; it contains one se'if. Everything joined to the ground that needs the ground is as the ground, and is acquired by money, or by a document, or by taking possession; even if he did not intend to acquire the ground, but took possession of the ground in order to acquire what is joined to it, or gave money for the ground in order to acquire what is joined to it, he has acquired, even though he did not acquire the ground. But if it does not need the ground — for example, grapes standing ready to be harvested — it is as movables as to acquisition, and the law of overreaching applies to them (and there are those who disagree and say that even if it does not need the ground, its law is as the ground) (Tur).
