Se’if 1א׳

דין קניית קרקע בשטר. ובו ד סעיפים: בשטר כיצד כתב לו על הנייר או על החרס או על העלה שדי נתונה לך שדי מכורה לך כיון שהגיע השטר לידו קנה אע"פ שאין שם עדים כלל:

The law of the acquisition of land by a document; it contains four se'ifim. By a document — how? He wrote for him on paper, or on a potsherd, or on a leaf: my field is given to you, my field is sold to you; once the document has reached his hand he has acquired, even though there are no witnesses there at all.

Se’if 2ב׳

בד"א במוכר שדהו מפני רעתה אבל בשאר קרקעות אע"פ שהגיע שטר המכר בעדים לידו לא קנה עד שיתן דמים:

When is this said? With one who sells his field because of its poor quality; but with other lands, even though the document of sale, with witnesses, has reached his hand, he has not acquired until he gives the price.

Se’if 3ג׳

שטרי דידן שטרי קנין הם: הגה והקרקע נקנה על ידו ואם כתב לו בפירוש שלא מכר לו בשטר ואינו אלא לראייה בעלמא אין הקרקע נקנית על ידו (הר"ן פ"ק דקדושין והמגיד פ"א דקדושין ופ"א דמכירה):

Our documents are documents of acquisition. Hagah [Rema]: And the land is acquired through it; but if he wrote for him expressly that he was not selling to him by the document, and that it is only as mere evidence, the land is not acquired through it (the Ran, chapter 1 of Kiddushin, and the Maggid, chapter 1 of Kiddushin and chapter 1 of the Laws of Sale).
