דין אין המקח נגמר בדברים. ובו סעיף אחד: אין המקח נגמר בדברים שהאומר לחבירו היאך אתה נותן לי חפץ זה ואמר ליה בכך וכך ונתרצו שניהם ופסקו הדמים יכולים לחזור שניהם אפי' היה הדבר בפני עדים ואמרו להם הוו עלינו עדים שמכר זה ושלקח זה הרי זה אינו כלום עד שיגמר המקח כל דבר ודבר כראוי לו קרקע לפי קניינו ובעלי חיים לפי קניינם ומטלטלים לפי קניינם ולאחר שנגמר המקח כל אחד לפי קניינו אין שום אחד מהם יכול לחזור בו אפי' לא היו עדים בדבר: הגה ואפי' מחלו זה לזה אח"כ לא מהני אלא צריכין לחזור ולהקנות זה לזה (תה"ד סי' שי"א וריב"ש סי' תק"י):
The law of a sale that is not completed by words; it contains one se'if. A sale is not completed by words. One who says to his fellow: for how much will you give me this article? and he said to him: for such-and-such, and both of them agreed and fixed the price — both of them can retract; even if the matter was before witnesses, and they said to them: be our witnesses that this one sold and that one bought, it is nothing, until the sale is completed, each and every thing as befits it: land according to its kinyan (a formal act of acquisition), animals according to theirs, and movables according to theirs. And once the sale has been completed, each according to its kinyan, neither of them can retract, even if there were no witnesses to the matter. Hagah [Rema]: And even if they afterwards released one another, it does not avail; rather they must convey to one another afresh (Terumat haDeshen, siman 311, and Rivash, siman 510).
