Se’if 1א׳
אין שליחות לעכו"ם ויש שליחות לעבד ואשה. ובו ו סעיפים: אין העכו"ם נעשה שליח לדבר מהדברים שבעולם וכן אין ישראל נעשה שליח לעכו"ם לדבר מהדברים:
A non-Jew cannot become an agent for anything in the world, so too, a Jew cannot become an agent for a non-Jew for anything.
Se’if 2ב׳
עושה אדם שליח איש או אשה ואפי' אשת איש ואפי' עבד ושפחה הואיל והם בני דעת וישנם במקצת מצות נעשים שלוחים למשא ומתן אבל מי שאינם בני דעת והם חרש שוטה וקטן אינם נעשים שלוחים ולא עושים שליח אחד הקטן ואחד הקטנה לפיכך השולח בנו קטן אצל החנוני (ונתן בידו פונדיון שהוא שני איסרין ונתנו לחנוני) ומדד לו באיסר שמן ונתן לו את האיסר ואבד את השמן ואת האיסר החנוני חייב לשלם שלא שלחו אלא להודיעו ולא היה לו לשלח אלא עם בן דעת וכן כל כיוצא בזה: הגה ועל הצלוחית שנתן המשלח ליד הקטן ומדד החנוני לתוכו אם שברו הקטן החנוני פטור אא"כ לקחו מידו ומדד לאחרים והחזירו לידו (טור) ואם פירש ואמר שלח לי עם הקטן ה"ז פטור:
A person may appoint as his agent a man or a woman, even a married woman, and even a male or female slave; since they are persons of understanding and are subject to some of the commandments, they become agents for business dealings. But those who are not persons of understanding — namely a deaf-mute, one who is not of sound mind, and a minor — do not become agents and do not appoint an agent, whether a boy or a girl. Therefore, one who sends his young son to the shopkeeper (and put in his hand a pondion, which is two issarin, and he gave it to the shopkeeper), and he measured out for him an issar's worth of oil and gave him back the issar, and the child lost the oil and the issar — the shopkeeper is liable to pay; for the father sent him only to let him know, and he ought to have sent it only with a person of understanding; and so in every case like this. Hagah [Rema]: And as for the flask that the sender put in the minor's hand and into which the shopkeeper measured: if the minor broke it, the shopkeeper is exempt, unless he took it from his hand and measured for others and put it back in his hand (Tur). And if he specified and said: send it to me with the minor, he is exempt.
Se’if 3ג׳
האומר לחבירו מנה שיש לי בידך בין מלוה בין פקדון שלחהו לי ביד פלוני אפי' היה קטן אם רצה לשלחו בידו נפטר ואינו חייב באחריותו :
One who says to his fellow: the maneh of mine that is in your hand, whether a loan or a deposit — send it to me by the hand of so-and-so; even if that one was a minor, if he chose to send it by his hand he is discharged and does not bear responsibility for it.
