Se’if 1א׳
דין שליח שטוען שאירע לו אונסין. ובו ד סעיפים: כל שליח שטען שאירעו אונס פלוני והפסיד כך וכך הרי זה נשבע שבועת השומרים על טענתו ויפטר ואם היה האונס במקום שאפשר להביא עליו עדים או דבר שהוא גלוי וידוע שהרי ימצא עדים הרי זה צריך להביא ראיה על טענתו ואם לא הביא עדים אינו נאמן ומשלם:
The law of an agent who pleads that mishaps befell him; it contains four se'ifim. Any agent who pleaded that such-and-such a mishap befell him and he lost so much — this one swears the oath of the bailees on his plea and is exempt. And if the mishap was in a place where it is possible to bring witnesses to it, or a thing that is revealed and known, so that he would find witnesses — this one must bring proof of his plea; and if he did not bring witnesses, he is not believed, and he pays.
Se’if 2ב׳
מעשה באחד שאמר לשלוחו קנה לי ארבע מאות גרבי יין ממעות שהיו לו בידו וקנה לו ונמצא חומץ אמרו חכמים מנין גדול כזה שהחמיץ קול יש לו הואיל ואפשר להביא ראיה יביא ראיה שלא היה היין חומץ בשעה שלקח ויפטר ואם לא יביא ראיה ישלם וכן כיוצא בזה מדברים שהראיה מצוייה בהן אבל דבר הנעלם שאין ראייתו מצויה ישבע עליו:
It happened with one who said to his agent: buy me four hundred jars of wine with money that he had in his hand — and he bought for him, and it was found to be vinegar. The Sages said: so great a number as this that turned sour has a report; since it is possible to bring proof, let him bring proof that the wine was not vinegar at the time that he bought it, and be exempt; and if he does not bring proof, let him pay. And likewise anything of this kind, among the things in which proof is readily found; but a hidden thing, whose proof is not readily found — he swears concerning it.
Se’if 3ג׳
וכן הדין בכל טענת שיטעון השותף כיוצא בו וכן הדין בטענת השומרים אם הראייה יכולה להיות או יביא ראיה על טענתו או ישלם: הגה ודוקא בטענת שומרין אבל בטענת פרעון והשבה וכיוצא בה דעבידי אינשי דפרעי בצנעה אפי' יש ראיה מפטר בשבועה (טור בשם הרמ"ה):
And the same is the law with any plea of this kind that the partner may plead; and the same is the law with the plea of bailees: if proof can be had, either he brings proof of his plea or he pays. Hagah [Rema]: And specifically with the plea of bailees; but with a plea of payment, and of return, and the like, since people commonly pay in private, even if there is proof he is exempted with an oath (Tur in the name of the Ramah).
