Se’if 1א׳
הלוקח כלים מן האומן למכור. ובו ב סעיפים: הלוקח כלים מבית האומן לשגרן לבית חמיו ואמר לו אם מקבלים אותן ממני אתן לך דמיהם ואם לאו אתן לך שכר מועט ונאנסו בהליכה חייב ואם נאנסו בחזרה פטור אבל אם נגנבו או אבדו חייב:
One who takes vessels from the craftsman to sell; it contains two se'ifim. One who takes vessels from the craftsman's house to send them to his father-in-law's house, and said to him: if they accept them from me, I will give you their price, and if not, I will give you a small fee — if they were lost by mishap on the way there, he is liable; and if they were lost by mishap on the return, he is exempt. But if they were stolen or lost, he is liable.
Se’if 2ב׳
נטלם ע"מ למכרם וא"ל אם ימכרו במקום פלוני או עד זמן פלוני אתן לך דמים כך וכך ואם לא ימכרו אחזירם לך ונאנסו בין בהליכה בין בחזרה חייב לשלם וי"א דהני מילי בדבר שיש לו קונים הרבה ויכול למכרו מיד בדמים שקצב אלא שמחזיר למכרו ביותר כדי שישתכר בו דאל"כ פטור מאונסים ואינו חייב אלא בגניבה ואבידה כדין סרסור: הגה ואם קצב לו דמים ואמר לו כל הריוח מזה נחלוק בינינו אין לו אלא דין סרסור ואינו חייב באונסים (ב"י) :
If he took them in order to sell them, and said to him: if they are sold in such-and-such a place, or by such-and-such a time, I will give you so-and-so much money for them, and if they are not sold I will return them to you — and they were lost by mishap, whether on the way there or on the return, he is liable to pay. And some say that this applies to a thing that has many buyers, and he can sell it at once at the price he fixed, only that he goes about to sell it for more so as to profit by it; for otherwise he is exempt from mishaps, and is liable only for theft and loss, as the law of a broker. Hagah [Rema]: And if he fixed a price for him and said to him: all the profit from this we will divide between us — he has only the law of a broker, and he is not liable for mishaps (Beit Yosef).
