Se’if 1א׳

סרסור שמכר בפחות או ביותר ממה שאמר לו בעל הבית ושאר טענות שבינו לבין בעל הבית. ובו י סעיפים: הסרסור שליח הוא אלא שנוטל שכר שליחותו לפיכך אם שינה דעת הבעלים משלם מה שהפסיד כיצד ראובן שנתן חפץ לשמעון הסרסור וא"ל מכור לי זה ואל תמכור בפחות ממאה והלך ומכרו בחמשים משלם החמשים מביתו מכר במאתים הכל לראובן: הגה מי ששלח שליח להוליך לו דבר למקום אחד ובתוך כך שלח לו דורון הוי שומר שכר (הגהות מרדכי דב"מ):

A broker who sold for less or for more than the householder told him, and the other disputes between him and the householder; it contains ten se'ifim. The broker is an agent, only that he takes hire for his agency. Therefore, if he departed from the owner's wishes, he pays what he lost. How so? Reuven, who gave an article to Shimon the broker and said to him: sell this for me, and do not sell it for less than a hundred — and he went and sold it for fifty — he pays the fifty from his house. If he sold it for two hundred, all goes to Reuven. Hagah [Rema]: One who sent an agent to take something for him to a certain place, and in the meantime sent him a present, is a paid bailee (Hagahot Mordechai on Bava Metzia).

Se’if 2ב׳

אין שליח יכול לקנות לעצמו אפי' באותם דמים שהרשוהו בעלים למכרו:

An agent cannot buy for himself, even at that same price for which the owner authorised him to sell it.

Se’if 3ג׳

נתן חפץ לסרסור למכרו בארבעה ואמר הסרסור כשבא החפץ לידו הילך ארבעה בשבילו ונתפייס המוכר אינו יכול לחזור בו אע"ג דמעיקרא לאו אדעתא דהכי נתנו לו:

If he gave an article to a broker to sell it for four, and the broker said, when the article came into his hand: here are four for it — and the seller was content, he cannot retract, even though at the outset they did not give it to him with this in mind.
