הקונה שדה על שם אחר ואחר כך אומר שהוא לעצמו (ודין שליח שמנה לג' ביחד). ובו ב סעיפים: ג' שנתנו מעות לאחד לקנות להם מקח אם היו המעות מעורבים וקנה במקצת הדמים אע"פ שהיתה כוונת השליח שזה שקנה לא' מהם הרי המקח של כולם וחולקים אותו לפי מעותיהם: הגה מיהו אם פירש בהדיא שקנה לאחד מהן הרי חזר משליחות האחרים וזכה זה שקנה לו (טור בשם ר' ישעיה) היו מעות של כל א' מהם צרורים וחתומים אע"פ שהיה בלב השליח הזה שיקנה המקח לכלם לא קנה אלא זה שקנה המקח במעותיו בלבד:

One who buys a field in another's name and afterwards says that it is for himself (and the law of an agent whom three appointed together); it contains two se'ifim. Three who gave money to one person to buy them a purchase: if the money was mixed and he bought with part of the price, even though the agent's intention was that what he bought be for one of them, the purchase belongs to all of them, and they divide it according to their money. Hagah [Rema]: However, if he specified explicitly that he bought for one of them, he has withdrawn from the agency of the others, and the one for whom he bought has acquired (Tur in the name of Rabbi Yeshayah). If each one's money was bound and sealed, even though it was in this agent's heart to buy the purchase for all of them, only the one with whose money he bought the purchase has acquired.

ראובן שקנה שדה משמעון ואמר ליה ללוי קניתי אותה וכתב שטר מכר בשם לוי וחזר ראובן ואמר לשמעון לעצמי קניתיה חזור וכתוב שטר מכר בשמי אין כופין את המוכר לכתוב לו שטר אחר בשם ראובן ואם התנה עמו מתחלה ואמר ליה לעצמי אני קונה וזה שאכתוב שטר בשם לוי כדי שלא ידעו בי שאני הוא הקונה הרי זה כופהו לכתוב שטר אחר בשמו ולא עוד אלא אפי' לא אמר כן למוכר אלא שאמר לעדים תחלה בפני המוכר יש לכם לכתוב לי שטר אחר על שמי כופין אותו לכתוב שטר אחר על שמו: הגה ואם קנה קרקע תחלה על שם לוי אע"פ שלוי לא עשהו שליח אם קנה במעות לוי לא יוכל לחזור בו (הגהות מרדכי פ"ד דמציעא):

Reuven who bought a field from Shimon and said to him: I bought it for Levi — and he wrote a document of sale in Levi's name — and Reuven went back and said to Shimon: I bought it for myself; write again a document of sale in my name — they do not compel the seller to write him another document in Reuven's name. And if he stipulated with him at the outset and said to him: I am buying for myself, and this, that I will have a document written in Levi's name, is so that they should not know that I am the buyer — this one compels him to write another document in his name. And not only this, but even if he did not say so to the seller, but said first to the witnesses, in the seller's presence: you are to write me another document in my name — they compel him to write another document in his name. Hagah [Rema]: And if he bought land at first in Levi's name — even though Levi did not make him an agent — if he bought it with Levi's money, he cannot retract (Hagahot Mordechai, chapter 4 of Bava Metzia).
