Se’if 1א׳

עשה שליח לקנות לו חטין וקנה לו שעורים. ובו ט סעיפים: הנותן מעות לשלוחו לקנות לו סחורה ידועה ולא לקחה אין לו עליו אלא תרעומת ואם ידוע שלקח (במעות המשלח) מוציא ממנו בעל כרחו:

He made an agent to buy him wheat, and he bought him barley; it contains nine se'ifim. One who gives money to his agent to buy him a known merchandise, and he did not buy it — he has against him only a grievance; and if it is known that he bought it (with the sender's money), he takes it from him against his will.

Se’if 2ב׳

הנותן מעות לחבירו לקנות לו קרקע או מטלטלים והניח מעות חבירו אצלו והלך וקנה לעצמו במעותיו מה שעשה עשוי והרי הוא מכלל הרמאים ואם היה יודע שזה המוכר אוהב אותו ומכבדו ומוכר לו ואינו מוכר למשלחו ה"ז מותר לקנות לעצמו והוא שיודיענו ואם מפחד שמא יבא אחר ויקדמנו לקנות הרי זה קונה לעצמו ואח"כ מודיעו: הגה קנאה סתם במעותיו יכול לומר אח"כ לעצמי קניתי (ב"י בשם ר"ן פ"ב דקידושין) ודוקא בקרקע סתם אבל בקרקע מיוחד הואיל והוא מנהג רמאות ודאי מעיקרא קנאה משלח ולא יכול לחזור בו (ר"ן ספ"ב דקידושין) קנאה בא' מדרכי הקנאה בלא מעות זכה המשלח ואפי' מכרה השליח אינו כלום (ב"י בשם תשובת הרשב"א):

One who gives money to his fellow to buy land or movables for him, and he left his fellow's money with himself and went and bought for himself with his own money — what he did is done, and he is among the deceivers. And if he knew that this seller loves him and honours him and sells to him, and does not sell to the one who sent him, this one is permitted to buy for himself, provided that he informs him; and if he fears lest another come and get ahead of him in buying, this one buys for himself and afterwards informs him. Hagah [Rema]: If he bought it without specification with his own money, he can say afterwards: I bought for myself (Beit Yosef in the name of the Ran, chapter 2 of Kiddushin). And specifically with land without specification; but with designated land, since it is a practice of deceit, the sender certainly acquired it from the outset, and he cannot retract (the Ran, end of chapter 2 of Kiddushin). If he bought it by one of the modes of acquisition without money, the sender acquired, and even if the agent sold it, it is nothing (Beit Yosef in the name of a responsum of the Rashba).

Se’if 3ג׳

שליח שקנה לעצמו במעות המשלח אע"פ שזקפן עליו במלוה המקח של משלח: הגה מיהו אם אמר השליח לפני עדים שחוזר בשליחותו י"א דקנה לעצמו (המגיד פ"ז דמכירה ומרדכי פ' הגוזל קמא) וי"א דבכל ענין הוא של המשלח (ר' ירוחם נכ"ו ח"א וב"י סי' קע"ו שתי הדעות):

An agent who bought for himself with the sender's money — even though he set it against himself as a loan, the purchase is the sender's. Hagah [Rema]: However, if the agent said before witnesses that he withdraws from his agency, some say that he acquired for himself (the Maggid, chapter 7 of the Laws of Sale, and Mordechai, chapter "One who robs, the former"); and some say that in any case it is the sender's (Rabbeinu Yerucham, netiv 26, part 1, and Beit Yosef, siman 176, the two views).
