Se’if 1א׳
כיצד נעשה שליח או טעה וקנה ביוקר ואם עבר על דעת משלחו. ובו יב סעיפים: הגה בכל דבר שלוחו של אדם כמותו חוץ מלדבר עבירה דקיימא לן אין שליח לדבר עבירה (טור) ודוקא שהשליח בר חיובא אבל אם אינו בר חיובא הוי שליח אפי' לדבר עבירה (הגהות מיימוני פרק ה' דשלוחין) : האומר לשלוחו צא ומכור לי קרקע או מטלטלין או קנה לי הרי זה מוכר ולוקח ועושה לו שליחותו וכל מעשיו קיימין ואין העושה שליח צריך קנין ולא עדים אלא באמירה בעלמא בינו לבין חבירו ואין צריך עדים אלא לגלות הדבר אם כפר א' מהם: הגה ולכן האומר לחבירו קח סחורה זו ואשתתף עמך והלך וקנאה לא יכול לחזור בו דהוי כשלוחו (תשובת הרשב"א סי' אלף ו'):
How one becomes an agent; or he erred and bought dear; and if he went against the wishes of the one who sent him; it contains twelve se'ifim. Hagah [Rema]: In every matter a man's agent is as himself, except for a transgression, for we hold that there is no agent for a transgression (Tur); and specifically where the agent is subject to the obligation, but if he is not subject to the obligation, he is an agent even for a transgression (Hagahot Maimoni, chapter 5 of the Laws of Agents). One who says to his agent: go out and sell land or movables for me, or buy for me — this one sells and buys and carries out his agency for him, and all his acts stand. And one who appoints an agent needs neither a kinyan (a formal act of acquisition) nor witnesses, but mere speech between himself and his fellow; and witnesses are needed only to reveal the matter, if one of them denied. Hagah [Rema]: And therefore one who says to his fellow: buy this merchandise and I will be a partner with you — and he went and bought it — cannot retract, for he is as his agent (a responsum of the Rashba, siman 1006).
Se’if 2ב׳
עבר השליח על דעת משלחו לא עשה כלום ודוקא שהודיע שהוא שליח של פלוני לפיכך אע"פ שמשך או המשיך אם נמצא שעבר על דעת משלחו בטל המקח ומחזיר אבל אם לא הודיעו שהוא שלוחו של פלוני נקנה המקח ויהיה הדין בינו ובין זה ששלחו:
If the agent went against the wishes of the one who sent him, he has done nothing — and specifically where he made known that he is so-and-so's agent. Therefore, even though he drew it or had it drawn, if it is found that he went against the wishes of the one who sent him, the purchase is void, and he returns it. But if he did not make known to him that he is so-and-so's agent, the purchase is acquired, and the dispute is between him and the one who sent him.
Se’if 3ג׳
טעה וקנה ביוקר אפי' בכל שהוא המקח בטל בין בקרקע בין במטלטלין שיאמר לו לתקוני שדרתיך ולא לעוותי לפיכך אם התנ' עמו שעשהו שליח בין לתיקון בין לעוות אפי' מכר לו שוה מנה בדינר או לקח לו שוה דינר במנה אינו יכול לחזור בו וחייב המשלח ליתן כפי התנאי: הגה מי שצוה לאחד שיתעסק לו באיזו דבר והוא הוציא עליו הוצאות אם הוציא עליו יותר מן הרגילות להוציא על עסק כזה א"צ להחזיר דלא אסיק אדעתיה שיוציא כל כך אבל אם לא הוציא יותר מן הרגילות חייב לשלם לו (מהרי"ק שורש י') ואם יש טענה ביניהם ע' לעיל סי' צ"א סעיף ג' וסי' צ"ג סעיף ד':
If he erred and bought dear, even by any amount at all, the purchase is void, whether with land or with movables; for he can say to him: I sent you to benefit me and not to harm me. Therefore, if the one who made him an agent stipulated with him, whether for benefit or for harm, even if he sold for him what is worth a maneh for a dinar, or bought for him what is worth a dinar for a maneh, he cannot retract, and the sender must give according to the stipulation. Hagah [Rema]: One who commanded someone to deal for him in some matter, and he laid out expenses on it: if he laid out on it more than it is usual to lay out on such business, he need not repay him, for he did not have it in mind that he would lay out so much; but if he did not lay out more than is usual, he is liable to pay him (Maharik, shoresh 10).
