Se’if 1א׳
שיירא שעמד עליהם גייס והציל א' מהם. ובו ג סעיפים: שיירא שהיתה הולכת במדבר ועמד עליה גייס וטרפה אם אינם יכולים להציל מידם ועמד א' מהם והציל הציל לעצמו ואם יכולים הם להציל וקדם אחד מהם והציל אע"פ שאמר לעצמי אני מציל הציל לאמצע ויטול כל א' מהם שלו היו יכולים להציל ע"י הדחק כל המציל מציל לאמצע אלא א"כ אמר לעצמי אני מציל שאם אמר כן הרי זה מציל לעצמו שכיון ששמעו שהוא אומר לעצמי אני מציל היה להם לדחוק עצמם ולהציל וכיון שישבו ולא הצילו הרי נתייאשו מן הכל:
A caravan that a troop attacked, and one of them rescued; it contains three se'ifim. A caravan that was travelling in the wilderness, and a troop attacked it and plundered it: if they cannot rescue from their hand, and one of them arose and rescued, he has rescued for himself. And if they are able to rescue, and one of them went ahead and rescued, even though he said: I am rescuing for myself, he has rescued for the common stock, and each one of them takes his own. If they were able to rescue with difficulty, whoever rescues rescues for the common stock, unless he said: I am rescuing for myself; for if he said so, this one rescues for himself — for since they heard him saying: I am rescuing for myself, they should have exerted themselves and rescued, and since they sat and did not rescue, they have despaired of all of it.
Se’if 2ב׳
היו שני שותפים והציל אחד מהם הציל לאמצע ואם אמר לעצמי אני מציל הרי זה חלק מחבירו והציל לעצמו: הגה כל מה שהגיע לחלקו אבל אם הציל יותר הוא שלהם ודוקא שהם יכולים להציל אבל אם אינן יכולין להציל הכל שלו (טור) וע"ל סימן קע"ו סכ"ח ואם אמר שאמר שהציל לעצמו ואין לו עדים נשבע על כך ומחזיק לעצמו (מרדכי פרק הגוזל בתרא בשם ראבי"ה):
If there were two partners and one of them rescued, he has rescued for the common stock; and if he said: I am rescuing for myself, this one has divided from his fellow and rescued for himself. Hagah [Rema]: All that came to his share; but if he rescued more, it is theirs. And specifically where they are able to rescue; but if they are not able to rescue, all is his (Tur). And see above, siman 176, se'if 28. And if he said that he had said he was rescuing for himself, and he has no witnesses, he swears to it and keeps it for himself (Mordechai, chapter "One who robs, the latter", in the name of Raavyah).
Se’if 3ג׳
וכן השוכר את הפועל להציל כל שיציל הרי הוא למשכיר ואם אמר לעצמי אני מציל ה"ז חוזר בו מהשכירות וכל שיציל אחר שאמר לי הרי הוא שלו:
And likewise one who hires a worker to rescue: all that he rescues belongs to the employer. And if he said: I am rescuing for myself, this one retracts from the hire, and all that he rescues after he said so is his.
