Se’if 1א׳
שותף שבקש מהמוכס שימחול לו. ובו ג סעיפים: שותפים שבקש אחד מהם מהמוכס שימחול לו ומחל לו הוא לאמצע כאלו הוא שלוחם לבקש בשביל כלם ואם מעצמו בלא פיוס אמר אני מוחל בשביל פלוני הוא שלו לבדו:
A partner who asked the tax-collector to waive it for him; it contains three se'ifim. Partners, one of whom asked the tax-collector to waive it for him, and he waived it for him — it goes to the common stock, as though he were their agent to ask on behalf of all of them. And if, of his own accord and without appeasement, he said: I waive it for the sake of so-and-so — it is his alone.
Se’if 2ב׳
מי שפטרו המלך מכל מסים וארנוניות אע"פ כן חייבי' לפרוע במה שהוציאו הצבור בצרכי הצבור ובשמירתן (וע' לעיל סי' קס"ג):
One whom the king exempted from all taxes and levies — even so they are liable to pay in what the community spent for the needs of the community and for their protection (and see above, siman 163).
Se’if 3ג׳
שותף שירד לתוך שדה המשותף ועבדה חשוב כיורד ברשות ונוטל כדין אריסי העיר אפי' בקמה העומדת לקצור ואפילו בשדה שאינה עשויה ליטע והוא הדין אם מתעסק בלא רשות בדבר המטלטל המשותף: הגה ואין השותף נוטל הוצאה רק כפי השבח שמשביח ואם לא השביח כלום אינו נוטל כלום (נ"י פ' חזקת הבתים ומרדכי פרק הגוזל בתרא) ואם מיחה השותף השני שלא לעשות כגון שבנה בנין והוא מוחה בו אם הוא דבר שא"א מלבנות צריך חבירו ליתן לו חלקו ואם אינו צריך לבנות יכול חבירו לומר לו טול עציך ואבניך. (הגה מיי' הל' גזילה):
A partner who went down into the shared field and worked it is regarded as one who went down with permission, and he takes according to the law of the sharecroppers of the city — even with standing grain ready to be reaped, and even with a field that is not made for planting. And the same holds if he deals without permission in a shared movable thing. Hagah [Rema]: And the partner takes expense only according to the improvement that he makes; and if he improved nothing, he takes nothing (Nimukei Yosef, chapter "The presumption of houses", and Mordechai, chapter "One who robs, the latter"). And if the second partner protested that he should not do so — for example, he built a building and he protests against him — if it is a thing that cannot but be built, his fellow must give him his share; and if it need not be built, his fellow can say to him: take your timber and your stones (Hagahot Maimoni, Laws of Robbery).
