Se’if 1א׳

שותפים שאחד מהם ירד לאומנות המלך או חלה. ובו ה סעיפים: א' מהאחים שמינהו המלך גבאי או סופר שמכניס ומוציא בממון המלך וכן כל כיוצא בזה מעבודת המלך אם מחמת אביהם מינהו כגון שהיה אביהם ידוע בדבר זה ואמר נעמיד בנו תחתיו כדי לעשות חסד עם היתומים הפרס שיטול וכל השכר שישתכר בעבודה לכל האחים ואפי' הי' חכם ביותר וראוי למנותו ואם מחמת עצמו מינוהו הרי זה לעצמו והוא הדין להפסד שאם נטל ממנו המלך מחמת ממון האחים ועשרם ההפסד לכולם ואם מחמת עצמו שכבר היה עשיר ההפסד לעצמו: הגה וכל זה באחין השותפין עדיין בנכסי אביהן אבל חלקו לא (טור בשם ר' יונה) וי"א דהוא הדין בשותפים אחרים אם נטל אחד מהן בשביל כולן הריוח וההפסד לאמצע (טור) וי"א דוקא לאומנות המלך אבל לאומנות אחרת הכל לעצמו (שם בשם הר"י הלוי וב"י בשם הרמב"ן) וי"א דאפי' באומנות המלך הוא נוטל תחילה טורח מלאכתו כפועל בכל יום (שם בשם ה"ר יונה):

Partners, one of whom went down into the king's service, or fell sick; it contains five se'ifim. One of the brothers whom the king appointed a collector, or a scribe who brings in and pays out the king's money, and likewise anything of this kind of the king's service: if he appointed him on account of their father — for example, their father was known in this thing, and he said: let us set up his son in his place, to do kindness with the orphans — the allowance he takes and all the wage he earns in the service belong to all the brothers, even if he was very wise and fit to be appointed; and if they appointed him on his own account, this is for himself. And the same holds for the loss: if the king took from him on account of the brothers' property and their wealth, the loss is on all of them; and if on his own account, for he was already rich, the loss is his own. Hagah [Rema]: And all this with brothers who are still partners in their father's property; but if they divided, no (Tur in the name of Rabbeinu Yonah). And some say that the same holds for other partners: if one of them took on behalf of all of them, the profit and the loss go to the common stock (Tur). And some say, specifically for the king's service, but for another office all is his own (there, in the name of the Ri haLevi, and Beit Yosef in the name of the Ramban). And some say that even in the king's service he first takes the trouble of his work, as a worker by the day (there, in the name of Rabbeinu Yonah).

Se’if 2ב׳

חלה אחד מהם אם בפשיעה כגון שהלך בשלג בחורף או בחום בימות החמה וכיוצא בזה אם יש קצבה לרפואתו מתרפא בשלו ואם אין לה קצבה מתרפא מן האמצע אבל אם חלה באונס אפי' יש לה קצבה מתרפא מן האמצע וקודם שנתרפא יכולים לומר לו חלוק עמנו: הגה וי"א בהיפך דפשיעה בכל ענין אינו מתרפא מן האמצע ובחלה באונס דוקא רפואה שאין לה קצבה מתרפא מן האמצע (טור):

If one of them fell sick: if through negligence — for example, he went in the snow in winter or in the heat in the summer days, and the like — if there is a fixed limit to his cure, he is healed from his own, and if it has no fixed limit, he is healed from the common stock. But if he fell sick through mishap, even if it has a fixed limit, he is healed from the common stock. And before he is healed they can say to him: divide with us. Hagah [Rema]: And some say the reverse: that with negligence, in any case, he is not healed from the common stock; and when he fell sick through mishap, only a cure that has no fixed limit is from the common stock (Tur).

Se’if 3ג׳

בד"א שנתרפא מן האמצע כשהוא לבדו מתעסק באומנות והשאר בטלים ונוטלים חלק בריוח אבל שני שותפים שמתעסקים באומנות או בסחורה וחלה אחד מהם אפי' באונס מתרפא משל עצמו: הגה ודוקא שאינן ניזונין מן השותפות אבל ניזונין מן השותפות וחלה באונס כל רפואה שאין לה קצבה כמזונות דמיא (ב"י לדעת הרא"ש) ואם שותף חייב לפדות חבירו ע' לעיל סי' קע"ו סמ"ח:

When is it said that he is healed from the common stock? When he alone deals in the craft, and the rest are idle and take a share of the profit; but two partners who deal in a craft or in trade, and one of them fell sick, even through mishap — he is healed from his own. Hagah [Rema]: And specifically where they are not maintained from the partnership; but if they are maintained from the partnership and he fell sick through mishap, any cure that has no fixed limit is like maintenance (Beit Yosef, following the view of the Rosh).
