Se’if 1א׳

Partners have no presumptive possession against one another; it contains one se'if. A thing known to be the partnership's — one has no presumptive possession in it against his fellow; and even if it stayed in his hand a long time, he cannot say that he bought it from him or that he gave it to him as a gift, except with proof. And it need not be said in a matter known to belong to the two of them equally; but even if they saw that this one brought money and that one brought money, and they bought merchandise with it, and it is not known how much each one brought, and after this the merchandise came out from the hand of one of them, and he said: two thirds are mine and a third my partner's — he is not believed, but they divide it equally. And this is where he cannot plead: it never happened, or: I returned it to you — for example, witnesses saw it under his hand and knew that this was the merchandise that the two of them bought. Hagah [Rema]: And specifically before they divided; but after they divided, they have presumptive possession against one another (Beit Yosef in the name of the Rif, and so it is implied from the words of the Rambam, chapter 5 of the Laws of Partners; and see above, siman 149).
