Se’if 1א׳
אחין שרצו לחלק וכל דיני דבר מצרא. ובו סג סעיפים: לא היו כאן כל האחים ואותו שלפנינו מבקש לחלוק חולק בפני שלשה אפילו הם הדיוטות ובלבד שיהיו נאמנים ובקיאים בשומא ואם חלק בפחות משלשה לא עשה כלום ואם היו מעות וכולם מטבע אחד ושוים א"צ שלשה אלא שנים לראיה בעלמא: הגה וכן אם היו הנכסים מופקדים ביד אח' ובאו מקצת האחין נותנין להן חלקן בדרך הנזכר (מרדכי פ' המפקיד וע"ל סי' ע"ז ס"ט):
Brothers who wished to divide, and all the laws of the adjoining owner (the owner of land bordering a field that is sold, who may take it in the buyer's place); it contains sixty-three se'ifim. If not all the brothers were here, and the one who is before us seeks to divide, he divides before three, even if they are laymen, provided that they are trustworthy and expert in appraisal; and if he divided before fewer than three, he has done nothing. And if it was money, all of one coinage and equal, three are not needed, but two, merely as proof. Hagah [Rema]: And likewise, if the property was deposited in the hand of another and some of the brothers came, they give them their share in the manner mentioned (Mordechai, chapter "One who deposits"; and see above, siman 77, se'if 9).
Se’if 2ב׳
אם אחר שחלק זה בפני ג' שלא בפני אחיו ובא אחיו ואמר אותו החלק שוה בעיני יותר ואני מוסיף דמים יותר ממה ששמתם אותו שומעין לו לבטל החלוקה אבל אם בא לבטל החלוקה בלא טענה ולומר נפיל גורל אחר אין שומעין לו:
If, after this one divided before three not in his brother's presence, his brother came and said: that share is worth more in my eyes, and I add more money than what you appraised it at — they listen to him, to cancel the division. But if he comes to cancel the division without a plea, saying: let us cast another lot — they do not listen to him.
Se’if 3ג׳
שני אחים שחלקו ואח"כ בא אח שלא היו יודעים בו בטלה החלוקה ואפי' שהי' להם שלשה שדות ונטל כל א' מהם אחת מהן והשלישית חלוקה ביניהם וכשבא האח השלישי נפל חלקו באותה שחלקו ביניהם לא נאמר ישאר כל א' מהם בשלו אלא איזה מהם שירצה יכול לבטל כל החלוקה ויפילו גורל אחד לכולם ואפי' נתרצה האח השלישי ליטול מעט מזה ומעט מזה בלא גורל אפי' הכי יכול כל א' מהשנים לבטל החלוקה כיון שהיתה בטעות:
Two brothers who divided, and afterwards there came a brother of whom they did not know — the division is cancelled. And even if they had three fields, and each of them took one of them, and the third was divided between them, and when the third brother came his share fell in the one that they had divided between them — we do not say that each of them stays with his own; rather, whichever of them wishes can cancel the whole division, and they cast one lot for all of them. And even if the third brother consented to take a little from this one and a little from that one without a lot, even so each of the two can cancel the division, since it was made in error.
